<br />intended usage of Federal Revenue-Sharing funds applicable to the entitlement periods
<br />
<br />from January 1, 1972 through June 30, 1973, such funds being in the total amount
<br />
<br />of $402,330.00.
<br />
<br />Upon motion, duly seconded and unanimously carried, Council adopted the following
<br />
<br />ordinance providing for the adoption by the City of the Uniform Statewide Building
<br />
<br />Code, effective September 1, 1973:

<br />WHEREAS, Section 36-98 of the 1950 Code of Virginia, as amended, directed
<br />and empowered the State Board of Housing to adopt and promulgate a Uniform
<br />Statewide Building Code to supercede the existing building Codes and
<br />regulations of the counties, municipalities, and State agencies; and,
<br />
<br />WHEREAS, pursuant to the authority of Section 36-98, as aforesaid, the
<br />State Board of Housing has adopted and promulgated a Uniform Statewide
<br />Building Code; and,
<br />
<br />WHEREAS, Section 36-101 of said Code provides that said Uniform
<br />Statewide Building Code shall become effective on September 1, 1973; and,
<br />
<br />WHEREAS, Section 36-105 of said Code provides that enforcement of
<br />the Uniform Statewide Building Code shall be the responsibility of the
<br />local building department; now, therefore,
<br />
<br />BE IT ORDAINED by the Council of the City of Martinsvi11e, Virginia,
<br />in regular session held on August 28, 1973:
<br />(1) That the Virginia Uniform Statewide Building Code be, and the
<br />same hereby is, adopted by reference as a general ordinance of the City
<br />of Martinsvi1le; however, it shall not be necessary for the Clerk of
<br />the Council to copy into the Ordinances and the Council Minutes Books
<br />of the City said Uniform Statewide Building Code, but there shall be
<br />maintained in the office of the City Building Official a copy of said
<br />Code for public inspection;
<br />(2) That, an emergency existing, the provisions of said Uniform
<br />Statewide Building Code shall take effect on and after September 1, 1973;
<br />(3) That the Building Code of Martinsville, 1967, as amended,
<br />the Martinsville Plumbing Code, the Martinsville Electrical Code, and
<br />all ordinances of a general nature in conflict with said Uniform
<br />Statewide Building Code are hereby repealed as of September 1, 1973,
<br />except that the chapters in the Building Code of Martinsville 1967,
<br />and in the Martinsville Plumbing Code, and in the Martinsville
<br />Electrical Code, relating to and entitled "Administration" are
<br />retained in effect, and are amended to the extent that wherever the
<br />words "Southern Building Code" appear in said chapters relating to
<br />administration there shall be substituted in their place and stead
<br />the words "Uniform Statewide Building Code";
<br />(4) That the aforesaid repeal shall not affect any act or offense
<br />done or committed, or any penalty, forfeiture or punishment incorrect,
<br />or any right accruing or accrued, acquired or established, or any
<br />protection or proceeding pending at or on September 1, 1973; and
