<br />6 <br /> <br />TUESDAY <br /> <br />SEPTEMBER 12, 1972 <br /> <br />Mr. Cubine further stated that he has consistently, sincerely and to the best of <br /> <br />his ability discharged his duties as City Attorney and that no member of Council <br /> <br />has indicated in any way that his services have not been satisfactory. Councilman <br /> <br />Hartford stated that he was not in accord with the motion for the reasons that no <br /> <br />one has claimed that Mr. Cubine's services and performance have been dissatisfactory <br /> <br />and that, should they have been, he should have been so advised and put on notice <br /> <br />and that action to terminate his services should be taken only after such notice <br /> <br />and only after he had failed to heed such notice. Further comments by both Mr. <br /> <br />West and Mr. Cubine made reference to letters from Mr. West (dated July 31, 1972, <br /> <br />August 28, 1972, and September 11, 1972) to Mr. Cubine and Mr. Cubine's replies to <br /> <br />the first two such letters, following which Mr. Cubine suggested that--if Council <br /> <br />desires--his services be terminated at a point in this meeting, viz., 8:00 P.M., <br /> <br />September 12, 1972. The motion, with second, was accordingly amended and carried <br /> <br />(Ayes: Messrs. West, Hobson, and Lester; Against: Mr. Hartford; Vice-Mayor Boaz <br /> <br />did not vote); whereupon Mr. Cubine vacated his desk and Mr. Worthy was named to <br /> <br />succeed him for a tenure beginning immediately, i.e., effective September 13, 1972. <br /> <br />Council then took up its regular order of business, as per prepared agenda, by <br /> <br />considering a report of the Planning Commission with regard to Mr. Earle W. Greene's <br /> <br />Application for a Special-Use Permit (filed June 13, 1972) to allow construction of <br /> <br />an apartment complex on property owned by Mr. George C. Salmons, situated on the <br /> <br />south side of East Church Street (Route 58 East) and the east side of Salmons <br /> <br />Street, in which report fue Commission recommended issuance of such Special-Use <br /> <br />Permit subject to certain conditions and stipulations. Council was informed that <br /> <br />neither Mr. Greene nor Mr. Salmons was able to attend this meeting because both, <br /> <br />of necessity, had to be out of town. Meanwhile, in tentative acceptance of the <br /> <br />Commission's report and recommendations, Council called for a duly-advertised <br /> <br />public hearing to be conducted on said application and the Commission's recommendations <br /> <br />at Council's forthcoming October 10th meeting. <br />
