<br />r.: <br />t... <br /> <br />TUESDAY <br /> <br />SEPTEMBER 12, 1972 <br /> <br />The regular semi-monthly meeting of the Council of the City of Martinsville, Virginia, <br /> <br />with Mayor Francis T. West presiding, was held Tuesday, September 12, 1972, in the <br /> <br />Council Chamber, City Hall, beginning at 7:30 P.M., all members being present, viz., <br /> <br />Mayor Francis T. West; Harry L. Boaz, Vice Mayor; W. Donald Hartford; William D. Hobson; <br /> <br />and Morton W. Lester. <br /> <br />After the invocation, Council approved as recorded the minutes of its regular meeting <br /> <br />held August 22, 1972, and--with addendum indicating the supplemental appointment of <br /> <br />State Senator William F. Stone to the special "downtown study group" committee named <br /> <br />September 1, 1972--the minutes of its organizational and special meeting held <br /> <br />September 1, 1972. <br /> <br />Before taking up the regular order of business, Mayor West asked that Vice-Mayor <br /> <br />Boaz temporarily assume the position of presiding officer that Mayor West might bring <br /> <br />up a matter concerning personnel and that he might offer a motion thereon, viz., that <br /> <br />City Attorney Cubine be advised that his services as City Attorney will be terminated <br /> <br />as of October 15, 1972 and that Mr. David B. Worthy be appointed as City Attorney as <br /> <br />of October 15, 1972. Mr. West prefaced his motion by expressing appreciation to Mr. <br /> <br />Cubine for his services as City Attorney over the past eleven years and, also, <br /> <br />indicating that his motion has neither personal nor political implications. <br /> <br />Following Councilman Hobson's second to the motion, indicating his opinion that-- <br /> <br />after considerable thought and study of this matter--certain matters can not be <br /> <br />resolved, Mr. Cubine stated that to the best of his knowledge the effort to terminate <br /> <br />his services as City Attorney has been instigated and promoted solely by Mayor West <br /> <br />because Mr. Cubine went against Mr. West's wishes in the selecting and retaining of <br /> <br />additional legal counsel to help defend the City in the pending Federal Court case <br /> <br />of Fralin & Waldron vs. Martinsville City Council and Martinsville Planning Commission. <br />
