<br />198 <br /> <br />TmSMY <br /> <br />DECEMBER 13, 1977 <br /> <br />Consideration of a proposed ordinance, to give the Police Department authority <br /> <br />to ~nforce parking regulations applicable to areas within shopping centers <br /> <br />reserved for fire lanes, was continued until Council's next regular meeting <br /> <br />in order to provide owners of certain shopping centers sufficient time to <br /> <br />become familiar with the proposed ordinance as well as with the scope of the <br /> <br />authority of the Fire Chief to designate and/or require fire lanes on private <br /> <br />properties, such as shopping centers, about which Mr. George L. Nease (an <br /> <br />owner of several small shopping centers) expressed some concern and reservations. <br /> <br />Upon motion, duly seconded and unanimously carried, Council adopted the <br /> <br />following ordinance amending Section 10-75 of the Martinsville City Code, <br /> <br />prohibiting the parking of motor vehicles by non-handicapped persons in spaces <br /> <br />within certain areas reserved for vehicles of handicapped persons: <br /> <br />WHEREAS, Section 46.1-181.4:1 of the CODE OF VIRGINIA (1950, and as <br />amended) authorizes the governing body of any city in Virginia to <br />adopt an ordinance making it unlawful for a non-handicapped operator <br />of a motor vehicle to park in a parking space reserved for the <br />handicapped at privately-owned shopping centers and business offices <br />and, also, provides that a summons for any such offense may be issued <br />by such city's police officers without the necessity of a warrant <br />being obtained by the owner of such shopping center or business office; <br />now, therefore, <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular session held on December 13, 1977, that Division 1 of <br />ARTICLE IV of CHAPTER 10 of the Martinsville City Code be and is <br />hereby amended by adding thereto sub-section 10-75(c), reading as <br />follows: <br />No non-handicapped operator of a motor vehicle not containing <br />any handicapped passenger shall park such vehicle in any parking <br />space reserved for the handicapped at privately-owned shopping <br />centers and business offices, provided that notice reserving <br />such space for the handicapped is given by a sign erected thereat <br />or conspicuous letters have been painted therein. <br /> <br />BE IT FURTHER ORDAINED by said Council that a summons for any person <br />violating the foregoing may be issued by any police officer of the <br />City of Martinsville, Virginia, in accordance with the provisions of <br />Section 10-103 of the Code of the City of Martinsville, Virginia, <br />without the necessity of a warrant being obtained by the owner of <br />such shopping center or business office; and <br /> <br />BE IT FURTHER ORDAINED by said Council that an emergency exists and <br />that this ordinance shall be effective on and after date of its enactment. <br />
