<br />WHEREAS, the aforesaid offers of said petitioner were transmitted to said
<br />Council in the written recommendation of said Planning Commission; and,
<br />
<br />WHEREAS, after receipt of said recommendation, said Council held a duly-
<br />advertised public hearing on September 14, 1977, at which hearing the afore-
<br />said offers of the petitioner were repeated to said Council by agents of said
<br />petitioner at said hearing; and,
<br />
<br />WHEREAS, at the conclusion of said public hearing held by said Council on
<br />September 14, 1977, said Council voted unanimously, with Councilman West
<br />abstaining, to grant said petition; now, therefore,
<br />

<br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in
<br />regular session held on September 27, 1977, that the Zoning Ordinance of the
<br />City of Martinsville, Virginia, be, and the same hereby is, amended so that
<br />the Official Zoning Map, Martinsville, Virginia, shall be changed to portray
<br />the aforesaid subject parcel as part of a "C-l" Neighborhood Business District;
<br />and,
<br />
<br />BE IT FURTHER ORDAINED by said Council that said amendment shall not
<br />become effective until said change has been duly entered upon said Official
<br />Zoning Map; and,
<br />
<br />BE IT FURTHER ORDAINED by said Council that the offer of Lanier Farm, Inc.,
<br />to convey to said City enough right-of-way to provide for an additional traffic
<br />lane along the south side of Spruce Street from Parkview Avenue to Indian Trail,
<br />be, and the same hereby is, accepted as part of this zoning ordinance amendment;
<br />and,
<br />
<br />BE IT FURTHER ORDAINED by said Council that the offer of Lanier Farm, Inc.,
<br />to add, after consultation with a screening expert, to the existing screening
<br />between said subject parcel and Parkview Avenue and the synagogue fronting
<br />Parkview Avenue and to maintain all of said screening perpetually, be, and the
<br />same hereby is, accepted as part of this zoning ordinance amendment; and,
<br />

<br />BE IT FURTHER ORDAINED by said Council that if any sentence, clause, phrase
<br />or portion of this amendment is for any reason held invalid by any Court of
<br />competent jurisdiction, then such held invalid shall be deemed a separate,
<br />distinct, and independent provision and such holding shall not effect the
<br />validity of the remaining portions of this amendment.

<br />After receiving the following report from the City's Department of Social Services on behalf of
<br />
<br />the City's Welfare Board, concluding that there is a need for conducting a "Winterization Program"
