<br />~62 <br /> <br />t <br /> <br />TUESDAY <br /> <br />SEPTEMBER 27, 1977 <br /> <br />seeking permission to connect to a City water main along Chatham Road, outside the City's <br /> <br />corporate limits northeast of Martinsville, to serve a twelve-unit apartment complex <br /> <br />petitioner proposes to construct. Included in this notice and public hearing will be <br /> <br />consideration of issuing a Special-Use Permit for said proposed apartment complex. <br /> <br />With reference to Council's September 14th action, wherein Council approved the petition <br /> <br />of Lanier Farm, Inc., seeking the rezoning of certain of its property near the southeast <br /> <br />corner of Parkview Avenue and Spruce Street to "C-l Commercial", subject to certain <br /> <br />conditions to be set forth in an ordinance amending the City's Zoning Map, City Attorney <br /> <br />Worthy presented the following ordinance effecting said rezoning and setting forth the <br /> <br />conditions, which ordinance Council placed on first reading, with Councilman West abstaining, <br /> <br />for reasons previously cited in minutes of Council's deliberations and action on this matter: <br /> <br />WHEREAS, Lanier Farm, Inc., a corporation duly organized and existing under <br />the laws of the Commonwealth of Virginia, heretofore petitioned the Council of <br />the City of Martinsville, Virginia, to re-zone a certain lot or parcel of land <br />owned by Petitioner fronting on Spruce Street, in the City of Martinsville, <br />Virginia, from an "R-9" classification to a "C-l" classification, which lot or <br />parcel of land is more particularly shown on a certain map or plat submitted <br />in support of said petition, to which map reference is hereby made for a more <br />particular description of said lot or parcel of land, as though said map were <br />physically attached hereto; and, <br /> <br />WHEREAS, said petition was referred to the City Planning Commission; and, <br /> <br />WHEREAS, said Planning Commission held a duly-advertised public hearing on <br />said petition and thereafter recommended to said Council that said petition be <br />granted; and, <br /> <br />WHEREAS, said petitioner offered, as part of the proposed re-zoning, before <br />said Planning Commission to convey to said City enough right-of-way along the <br />south side of Spruce Street to provide for an additional traffic lane on the <br />south side of Spruce Street from Parkview Avenue to Indian Trail, and also <br />offered to consult with a screening expert, and, after such consultation, to <br />add to the screening already existing between said subject parcel and Parkview <br />Avenue and the synagogue fronting Parkview Avenue, and to maintain all of said <br />screening perpetually; and, <br />
