<br />'"'4 <br />' , <br />:1: <br /> <br />TUESDAY <br /> <br />AUGUST 23, 1977 <br /> <br />In connection with Council's re-referral on June 28, 1977, to the Planning Commission, of <br /> <br />Lanier Farm's May 10th petition seeking the rezoning of a portion of its property situated <br /> <br />near the southeast corner of Spruce Street and Parkview Avenue from "R-6 Residential" to <br /> <br />"C-l Commercial", on which the Planning Commission had submitted its report under date of <br /> <br />June 24, 1977 recommending that the rezoning request be granted (with a certain stipulation <br /> <br />as to reservation of an area for "screen planting"), the Planning Commission filed its <br /> <br />".~- <br /> <br />report (dated August 22, 1977), again recommending the rezoning request be granted, subject <br /> <br />to the aforesaid stipulation, which report was as follows: <br /> <br />The Planning Commission at its meeting on Thursday, August 18, 1977, <br />conducted a second Public Hearing with regard to a petition submitted <br />by Lanier Farms requesting the rezoning of additional property from <br />R-9 Residential to a C-l Commercial classification near the southeast <br />corner of Spruce Street and Parkview Avenue to allow for the construction <br />of a supermarket at that location. The rezoning petition as considered <br />would leave a strip approximately 40 feet in width along the east margin <br />on Parkview Avenue in the R-9 Residential classification for purposes <br />of screen planting. Proponents and opponents were represented by <br />attorneys and evidence was received from several sources concerning <br />traffic counts and safety, the environmental effect of the project on the <br />flow of water down stream from the project, the cost, relative safety and <br />design advantages and disadvantages of alternate locations of this proposed <br />store which would not require this rezoning, the economic benefit to the <br />City if the store is built as a result of the rezoning, the potential effect <br />of the proposed store on neighboring property values and the public demand <br />for the availability of such a store in this general area. The petitioners, <br />as a part of their presentation, offered to dedicate an additional twelve <br />feet of land along the south side of Spruce Street for the purpose of <br />alleviating potential traffic hazards and conditions of congestion, and <br />also offered to assist the City in any reasonable way in opening Kilowat <br />Street through to Brookdale, if this approach seems otherwise feasible. <br />The Petitioner also stated a willingness to have a professional landscape <br />contractor provide proper screening on the west and southwest sides of the <br />property and to so install outside lighting as to have it properly shielded <br />from nearby residential areas. <br /> <br />Based on the foregoing evidence, the Commission voted to recommend to Council <br />that this petition be granted with the reservation of a strip of land 40 <br />feet wide along the east side of Parkview, the parcel being recommended for <br />rezoning fronting approximately 110 feet on the south side of Spruce Street <br />and running back to a depth of approximately 250 feet. Members of the <br />Commission stated that they felt in making this decision that this store <br />would contribute to the tax base of the City and would tend to preserve the <br />present tax base in the immediate area, that the construction of a store as <br />presented by the Petitioner would answer a need and desire for such a store <br /> <br />--'~-'-'--'~'-"-'_.'-----""'-~----_.._.--_..-.__..,.----,--- <br />
