<br />:46 <br /> <br />TUESDAY <br /> <br />AUGUST 23, 1977 <br /> <br />expressed by many persons appearing before the Commission and that the <br />location of the building partially on the area petitioned for rezoning <br />would be a better location from an engineering and safety standpoint <br />than the other possible locations available for the store on the <br />Petitioner's property without utilization of the area petitioned for <br />rezoning. Commissioners also stated that they felt that the location <br />of the proposed store in this area would have a tendency to stabilize <br />the present population of the City. <br /> <br />With reference to the foregoing subject matter, but claiming that the following petition <br /> <br />filed on behalf of Dr. David W. Roycroft (seeking the rezoning of Lanier Farm's property <br /> <br />"lying between the Gulf Oil Station on the East and the land which is already zoned R-9 <br /> <br />on the West lying on the South side of Spruce Street" be rezoned to "P-l Professional" <br /> <br />or "R-9 Residential") is a separate matter, Messrs, John D. Epperly and Junius P. <br /> <br />Warren, Attorneys at Law, of the law firm of Broaddus, Epperly, Broaddus & Beck, <br /> <br />appeared before Council and requested deferment by Council of any further action on the <br /> <br />Lanier Farm rezoning petition, pending Council's referral of the Roycroft petition to the <br /> <br />Planning Commission and receipt by Council of the Commission's report and recommendation <br /> <br />thereon: <br /> <br />The undersigned, being an interested property owner in the area to be <br />affected, doth hereby petition Council, pursuant to Section 15.1-491 <br />of the Code of Virginia, to rezone all of the land lying between the <br />Gulf Oil Station on the East and the land which is already zoned <br />R-9 on the West lying on the South side of Spruce Street, in the City <br />of Martinsville, Virignia, from C-l Commercial to P-l Professional or <br />R-9 Residential. <br /> <br />The reason for this petition is that the existing C-l classification is <br />not conducive to protecting the real estate values of the adjoining and <br />other nearby property owners, that the C-l zoning is not harmonious to <br />the community, that the C-l zoning presently and will in the future lead <br />to congestion in the public streets and will beinimical to property values <br />in the area, and that it will lead to overcrowding of land, undue density <br />of population in relation to the community facilities existing or <br />available, obstruction of light and air, danger and congestion in travel <br />and transportation, or loss of life, health or property from fire, flood, <br />panic or other dangers, and in addition there is already existing an <br />adequate structure on the north side of Spruce Street which was formerly <br />used by the Kroger Company which could be conveniently enlarged and is served <br />by a large parking lot, and would in no way infringe upon nor do damage <br />to the property owner and others similarly situated. <br />
