<br />(';2 <br />:i <br /> <br />TUESDAY <br /> <br />JULY 26, 1977 <br /> <br />- <br /> <br />Pursuant to duly-advertised public notice, Council conducted a public hearing on a proposal, <br /> <br />supported by the Planning Commission, to rezone to "P-2 Professional" those properties <br /> <br />identified as 108 Fairy Street, llO Fairy Street, 704 Watt Street, and 706 Watt Street, <br /> <br />situated at the southeast corner of Fairy and Watt Streets, as requested (in part) by <br /> <br />Lester Properties by petition dated April 26, 1977. There being no objections to said <br /> <br />proposed rezoning, Council unanimously adopted the following ordinance effecting said <br /> <br />rezoning and amending the City's Zoning Map: <br /> <br />- <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled July 26, 1977, that the Zoning Map of <br />the City of Martinsville, Virginia be--and is hereby--amended to <br />effect and reflect a "P-2 Professional" zoning of properties <br />identified as 108 Fairy Street, llO Fairy Street, 704 Watt Street, <br />and 706 Watt Street, being at or adjacent to the southeast corner <br />of Fairy and Watt Streets. <br /> <br />Council was informed that Mr. Victor A. Lester (through his attorney), subsequent to <br /> <br />the following report of the Planning Commission, withdrew his application (dated April 26, <br /> <br />1977) for a Special-Use Permit which, if approved, would have allowed Mr. Lester to construct <br /> <br />a 40-unit apartment complex on Smith Lake Road, off Forest Street: <br /> <br />- <br /> <br />The Planning Commission at its meeting on Thursday, July 21, 1977, <br />gave consideration to evidence heard in the Public Hearing on that <br />date on the petition submitted by Mr. Victor A. Lester requesting <br />a Special Use Permit to allow him to construct an apartment complex <br />on property fronting Smith Lake Road just off Forest Street in South <br />Martinsville. At the beginning of this Public Hearing the request <br />for 40 units was reduced to 24 units. <br /> <br />Following consideration of this evidence the Commission voted five <br />to one with three abstentions to recommend to Council that this <br />petition be denied. <br /> <br />In reaching this decision, the Commission concluded that: <br /> <br />1. Because of the configuration of Forest Street, the lack of <br />sidewalks, and Forest Street being the only paved access to <br />the area, that any additional traffic would materially add <br />to the safety hazard in this area. <br />
