(';2 :i TUESDAY JULY 26, 1977 - Pursuant to duly-advertised public notice, Council conducted a public hearing on a proposal, supported by the Planning Commission, to rezone to "P-2 Professional" those properties identified as 108 Fairy Street, llO Fairy Street, 704 Watt Street, and 706 Watt Street, situated at the southeast corner of Fairy and Watt Streets, as requested (in part) by Lester Properties by petition dated April 26, 1977. There being no objections to said proposed rezoning, Council unanimously adopted the following ordinance effecting said rezoning and amending the City's Zoning Map: - BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in regular meeting assembled July 26, 1977, that the Zoning Map of the City of Martinsville, Virginia be--and is hereby--amended to effect and reflect a "P-2 Professional" zoning of properties identified as 108 Fairy Street, llO Fairy Street, 704 Watt Street, and 706 Watt Street, being at or adjacent to the southeast corner of Fairy and Watt Streets. Council was informed that Mr. Victor A. Lester (through his attorney), subsequent to the following report of the Planning Commission, withdrew his application (dated April 26, 1977) for a Special-Use Permit which, if approved, would have allowed Mr. Lester to construct a 40-unit apartment complex on Smith Lake Road, off Forest Street: - The Planning Commission at its meeting on Thursday, July 21, 1977, gave consideration to evidence heard in the Public Hearing on that date on the petition submitted by Mr. Victor A. Lester requesting a Special Use Permit to allow him to construct an apartment complex on property fronting Smith Lake Road just off Forest Street in South Martinsville. At the beginning of this Public Hearing the request for 40 units was reduced to 24 units. Following consideration of this evidence the Commission voted five to one with three abstentions to recommend to Council that this petition be denied. In reaching this decision, the Commission concluded that: 1. Because of the configuration of Forest Street, the lack of sidewalks, and Forest Street being the only paved access to the area, that any additional traffic would materially add to the safety hazard in this area.
