<br />37 <br /> <br />TUESDAY <br /> <br />APRIL 26, 1977 <br /> <br />Council considered, on third reading, a proposed "swimming pool" ordinance, as <br /> <br />introduced July 27, 1976 (to amend Article I of Chapter 9 of the City Code), as <br /> <br /> <br />subsequently revised after various consultations with several interested parties; <br /> <br /> <br />however, at the request of Mr. Seward M. McGhee (representing the ~uthside Pool <br /> <br />organization), who concurred with the need and intent of such an ordinance but <br /> <br />indiaated that immediate compliance with such an ordinance would result in a hardship, <br /> <br />Council continued consideration of said proposed ordinance until its next regular <br /> <br />meeting, meanwhile directing that City officials confer with the Southside group <br /> <br />and with any other group in similar circumstances in an effort to resolve problems <br /> <br />any such group might encounter should the ordinance be adopted and become effective <br /> <br />immediately. <br /> <br />Council referred to the Planning Commission, for its consideration and recommendations, <br /> <br />the following petitions and/or requests: <br /> <br />(1) A petition, filed by Mr. Benjamin R. Gardner, Attorney at Law and counsel <br /> <br />for petitioner (s), seeking the rezoning to "P-2 Professional" of property <br /> <br />located at 226 Starling Avenue: <br /> <br />(2) A petition, filed by Lester Properties on behalf of Mr. George W. Lester, II, <br /> <br />seeking a rezoning from "R-9 Residential" to "P-2 Professional" of Mr. Lester's <br /> <br />property located at 108 Fairy Street; and <br /> <br />(3) An application for a Special-Use Permit, filed by Mr. Benjamin R. Gardner, <br /> <br />Attorney at Law and Counsel for applicant, on behalf of Mr. Victor A. Lester, <br /> <br />seeking permission for applicant to be allowed to construct a forty-unit <br /> <br />apartment complex on Smith Lake Road. <br /> <br />CBD Chairman George ~ ~own, Assistant City Manager-Public Works Director, reported <br /> <br />that the CBD Commission recommends that City Obuncil authorize the City's Public Works <br />
