37 TUESDAY APRIL 26, 1977 Council considered, on third reading, a proposed "swimming pool" ordinance, as introduced July 27, 1976 (to amend Article I of Chapter 9 of the City Code), as subsequently revised after various consultations with several interested parties; however, at the request of Mr. Seward M. McGhee (representing the ~uthside Pool organization), who concurred with the need and intent of such an ordinance but indiaated that immediate compliance with such an ordinance would result in a hardship, Council continued consideration of said proposed ordinance until its next regular meeting, meanwhile directing that City officials confer with the Southside group and with any other group in similar circumstances in an effort to resolve problems any such group might encounter should the ordinance be adopted and become effective immediately. Council referred to the Planning Commission, for its consideration and recommendations, the following petitions and/or requests: (1) A petition, filed by Mr. Benjamin R. Gardner, Attorney at Law and counsel for petitioner (s), seeking the rezoning to "P-2 Professional" of property located at 226 Starling Avenue: (2) A petition, filed by Lester Properties on behalf of Mr. George W. Lester, II, seeking a rezoning from "R-9 Residential" to "P-2 Professional" of Mr. Lester's property located at 108 Fairy Street; and (3) An application for a Special-Use Permit, filed by Mr. Benjamin R. Gardner, Attorney at Law and Counsel for applicant, on behalf of Mr. Victor A. Lester, seeking permission for applicant to be allowed to construct a forty-unit apartment complex on Smith Lake Road.
