<br />170 <br /> <br />TUESDAY <br /> <br />APRIL 26, 1977 <br /> <br />the property owners hold to their written offer, Council was informed by City <br /> <br />Attorney Worthy of the probable costs (legal and court) the City might incur <br /> <br />if it institutes condemnation proceedings to acquire said right-of-way. Mean- <br /> <br />while, Vice-Mayor Cole and Councilman West, concurring in the need for this connector <br /> <br />street, expressed reservations about instituting comdemmation proceedings in <br /> <br />this case because of the possibility that an award by a condemnation proceeding-- <br /> <br />despite the value placed upon the property by ~ty officia1s--might cause the <br /> <br />project cost to exceed the Federal grant already tentatively approved for this <br /> <br />project. Upon motion, duly seconded, Council authorized the filing of a final <br /> <br /> <br />application for said Federal grant (of $8,500.00), the filing with the property <br /> <br /> <br />owners the City's official purchase offer, and the instructing and directing the <br /> <br /> <br />City Attorney to institute condemnation proceedings for the acquisition of said <br /> <br />property (in the event the property owners refuse the City's written offer), with <br /> <br />Mayor Hobson and Councilmen Greene and Oakes voting in the affirmative on the <br /> <br />motion and with Vice-Mayor Cole and Councilman West voting in the negative. <br /> <br />Upon recommendation of City Manager Noland, Council authorized the spending of up <br /> <br />to $26,000.00 from Revenue-Sharing funds during the current fiscal year for the <br /> <br />rebuilding of a fire pumper engine, inasmuch as the rebuilding work is currently <br /> <br /> <br />underway, in lieu of allocating $20,000.00 from 1977-78 Revenue-Sharing funds and <br /> <br /> <br />the encumbering of $6,000.00 from the 1976-77 appropriation for this work as <br /> <br /> <br />authorized by Council during its meeting of March 8, 1977. <br /> <br />Also, upon recommendation of City Manager Noland, Council allocated and appropriated <br /> <br />the sum of $38,029.00 from Federal Anti-Recession funds, already received, with <br /> <br />authorization to encumber this appropriation at June 30, 1977, to finance--in part-- <br /> <br />the cost of 1977-78 street paving and resurfacing. <br />
