<br />288 <br /> <br />TUESDAY <br /> <br />NOVEMBER 23, 1976 <br /> <br />Pursuant to Council's directive from its meeting of November 9, 1976, City <br /> <br />Attorney Worthy presented the following suggested resolution, providing for <br /> <br />the amending of Section 2 of Chapter 2 of the City Charter, pertaining to the <br /> <br />filling of vacancies--when they occur--on the Council, which suggested <br /> <br />resolution Council unanimously adopted and, pursuant thereto, called for a <br /> <br />duly-advertised public hearing thereon at Council's forthcoming December 14th <br /> <br />meeting: <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, <br />Virginia, in regular session this twenty-third day of <br />November, 1976, that it request the Virginia General <br />Assembly to amend the Charter of the City of Martinsville, <br />Virginia, by deleting therefrom the next-to-last sentence <br />of the second paragraph of Section 2 of Chapter 2 of said <br />Charter and (by) substituting therefor the following <br />language: <br /> <br />When a vacancy occurs in the Council, it shall be <br />filled by a majority vote of the remaining <br />members within thirty (30) days of such vacancy. <br />If a majority of the remaining members cannot <br />agree, or do not act within said thirty-day <br />period, and if at least 180 days remain in the <br />unexpired term at the expiration of said thirty- <br />day period, the Council, immediately upon <br />expiration of said thirty-day period, shall <br />petition the Circuit Court of the City of <br />Martinsville to issue a writ of election to fill <br />such vacancy. Upon receipt of such petition, the <br />Court shall issue the writ of election, directed to <br />the Secretary of the Electoral Board of the City of <br />Martinsville, designating the office to be filled and <br />the time and place of holding such election; and, <br />upon receipt of such writ, the said Secretary shall <br />publish a copy thereof at not less than ten (10) public <br />places within the City or publish the same in a <br />newspaper of general circulation at least ten (10) days <br />before such election. No such special election shall be <br />ordered held within the sixty (60) days prior to a <br />general or primary election. <br /> <br />
