<br />XVI <br /> <br />1- <br /> <br />b. Waste Treatment and Disposal - No new construction, addition, or <br />substantial improvements to existing waste treatment facilities <br />shall be allowed unless emergency plans and procedures for action <br />to be taken in the event of flooding are prepared, filed with, and <br />approved by the State Board of Health. These emergency plans and <br />procedures must show in detail steps taken against the possible <br />introduction of any pollutants or taxins into the flood waters. <br />There shall be no disposal of garbage or solid waste materials <br />within the Floodway Fringe District (F.F.). <br /> <br />4. Fill: <br /> <br />a. Any fill or materials proposed to be deposited in the F100dway <br />Fringe shall be allowed only upon issuance of a Conditional Use <br />Permit. The fill or materials must be shown to have some beneficial <br />purpose and the amount thereof shall not be greater than that shown <br />on the plan submitted by the owner showing the uses to which the <br />filled land will be put and the final dimensions of the proposed <br />fill or other materials. <br /> <br />b. Such fill or other materials shall be protected against erosion <br />by riprap, bulkheading, or vegetative cover. <br /> <br />c. The applicant must show that construction of the fill will not <br />substantially raise the water surface profile or will not cause <br />damage to upstream properties. <br /> <br />NONCONFORMING USES AND STRUCTURES <br /> <br />A structure or the use of a structure or premises which was lawful before the <br />adoption of this ordinance, but which is not in conformity with the provisions <br />of this ordinance, may be continued subject to the following conditions: <br /> <br />F100dway (F.W.), and Floodway Fringe (F.F.) Districts: <br /> <br />1. Existing nonconforming uses and structures shall not be expanded but <br />may be modified, altered, or reconstructed if floodproofing measures <br />are incorporated, provided such measures do not significantly raise <br />the level of the 100 year flood. <br /> <br />2. If such use is voluntarily discontinued for 24 months or more, any <br />future use of the building premises shall conform to this ordinance. <br /> <br />3. Repairs and maintenance work may be made to keep a nonconforming use <br />in sound condition. <br /> <br />4. Uses of adjuncts, which are or which become nuisances, will not be <br />entitled to continue as nonconforming uses. <br /> <br />5. Except as provided in Item 4 above, any use which has been permitted <br />as a Conditional Use shall be considered a conforming use. <br /> <br />-7- <br />
