<br />XVII <br /> <br />1- <br /> <br />/C <br /> <br />6. Whenever a nonconforming use has been changed to a conforming use, such <br />use shall not be changed back to a nonconforming use. <br /> <br />7. The provisions set forth in Section XVI are not intended and shall not <br />be construed to permit greater expansion, extension, or replacement than <br />is permitted under any existing Zoning Code Sections relating to non- <br />conforming uses. <br /> <br />SSE PERHIT <br /> <br />A. <br /> <br />Permits for the uses allowed in XIV-A and XV-A may be granted and issued <br />by the Building Official. Permits for Conditional Uses and Variances shall <br />be issued by the Building Official only after the Conditional Use or Variance <br />has been approved or granted by the Board. <br /> <br />B. <br /> <br />Application for Permitted Use, Conditional Use, and Variance Permits shall <br />be made in duplicate on forms furnished by the Building Official and shall <br />include the following, where applicable: plans in duplicate drawn to scale, <br />showing the nature, location, dimensions, and elevations of the lot; existing <br />or proposed structures, fill, or storage of materials, and the location of <br />the foregoing in relation to the channel. The effects of new fill or building <br />construction on the water surface profile must also be furnished to the <br />Building official. <br /> <br />C. <br /> <br />A Use Permit issued in conformity with the prov1s10ns of this ordinance by <br />the Building Official and bearing the signature of the City Engineer shall <br />be secured prior to the erection, addition, or alteration of any building, <br />structure, or land, and prior to the change or extension of a nonconforming <br />use. <br /> <br />D. <br /> <br />Use Permits issued in accordance with this ordinance and approved plans and <br />specifications shall permit only the use and construction set forth in such <br />approved plans. The applicant shall be required to submit certification by <br />a Professional Engineer registered in the commonwealth of Virginia that the <br />finished building floor elevation, floodproofing or other flood protection <br />measures were accomplished in compliance with this ordinance. <br /> <br />E. Variances _ Upon appeal in specific cases, the Board may issue a variance <br />from the terms of this ordinance, provided such variance is not contrary to <br />the public interest. Such variances will be issued on the basis that literal <br />implementation of this ordinance will produce undue hardship or discrimination; <br />however, no variance shall allow, in any district, uses which are prohibited <br />in that district, or permit a lower degree of flood protection, or permit <br />standards lower than those required by law. <br /> <br />F. Charges for Use Permits and the cost of public hearings shall be in accordance <br />with a schedule established by City Council; provided, however, the schedule <br />of charges for building permits issued under the Virginia Uniform Statewide <br />Building Code shall be in addition to any charges prescribed by Council for <br />administering this ordinance. <br /> <br />-8- <br />
