<br />is <br /> <br />TUESDAY <br /> <br />MAY 25, 1976 <br /> <br />the city even though the dog is both lawfully licensed <br />and vaccinated. <br /> <br />For the purpose of this section, the term "to run <br />at large" shall mean to roam, loiter, walk, run or be <br />off the premises of the owner or keeper without being <br />physically carried or held by leash, chain or other <br />restraint by a person thoroughly capable, both physically <br />and mentally, of controlling the dog, or (without being) <br />under the control of a reasonable person and obedient to <br />that person's command. <br /> <br />,- <br /> <br />Any person violating the prOV1Slons of this section <br />shall be guilty of a misdemeanor which shall be <br />punishable by a fine of not less than $5.00 nor more <br />than $25.00. <br /> <br />In lieu of the issuance of a criminal warrant <br />charging a violation of the provisions of this section, <br />and, in addition to, or, in lieu of the impoundment <br />required by Section 3-12 in accordance with Section <br />3-10 of this article, the impounding officer, or any <br />other authorized official designated by the City Manager, <br />may issue to the known owner or keeper of any dog found <br />at large in the City a notice of the violation of the <br />provisions of this section. Such notice shall impose <br />upon the owner or keeper a penalty of $5.00 which may, <br />at the discretion of the owner or keeper, be paid to the <br />City Treasurer within 72 hours in full satisfaction of <br />the assessed penalty. In the event such penalty is not <br />paid within the time prescribed, a criminal warrant <br />charging a violation of the provisions of this section <br />shall be issued. <br /> <br />Dr. Joseph E.
