i5 TUESDAY FEBRUARY 24, 1976 charges to local churches as well as the rate structure applicable to churches, including the automatic surcharges to be applied until 1979, at which point the present "church tariff" will go out of existence. In tentative acceptance of the Planning Commission's report and recommendation~ dated February 23~ 1976, Council called for a public hearing to be conducted at its forthcoming March 23rd meeting on the petition filed (December 30~ 1975) by Dr. William M. Chadduck~ requesting the rezoning from "R-9 Residential" to "P-2 Professional" those two certain lots situated between Dudley Street and Taylor's Supermarket, in the Jones Creek area near Northside Drive, with said public hearing to include the rezoning to "P-2 Professional" of the following area, expanding Dr. Chadduck's petition: The area bounded on the west by Northside Drive, on the north by Jones Creek, on the east by property owned by Appalachian Power Company, and on the south by Donovant Street~ all situated across Northside Drive opposite The Children's Playhouse and being adjacent to property on the north zoned "C-1 Commercial" and to property on the east zoned "M-2 Industrial". Upon motion~ duly seconded and unanimously carried~ Council authorized City Manager Noland to execute~ on behalf of the City~ a contract and/or agreement with the Norfolk & Western Railway Company whereby said railway company, subject to the conditions set forth in said contract and/or agreement~ will permit the City of Martinsvil1e and its Electric Department to construct an aerial 12 KV power line across the railway company's right-of-way at Mile Post R-67 + 5,216 feet to allow for more reliable electric service to Nationwide Homes and the surrounding area.
