iC,n. 0~ FEBRUARY 24, 1976 TUESDAY requested a refund of the difference between electric service charges billed by the City and paid by Mr. Merricks~ based on the City's commercial tariff, and the charges that would have been made under the City's residential tariff, for location at 205 Broad Street~ from February 14~ 1975~ the date Mr. Merricks~ of his own volition, combined or consolidated previously-separated electric service connections serving his residence and a small apartment unit to the rear of his residence~ Mr. Merricks stating that he did so on the assumption that the combined service would continue to be billed under the City's residential tariff and, thus~ would result in lesser electric service costs at that location when, actually, the costs have been much greater because the commercial tariff (with demand meter) became applicable. Mr. Merricks contended that he made the change in good faith and that he should have been forewarned and/or advised by the City that the commercial tariff (with demand meter) would apply and, thus~ result in higher electric service costs. After some discussion~ and upon motion (duly seconded and unanimously carried), Council directed that Mr. Merricks be refunded the difference to be determined by re-calcu1ating his electric consumption under the residential tariff~ from February 14~ 1975 to March 1, 1976~ with option afforded Mr. Merricks of separating the service for residential tariff application or continuing on a combined basis and being subject to the commercial tariff. In response to Council's request from its February lOth (1976) meeting~ City Manager Noland presented a tabulation reflecting electric service
