<br />iC,n. <br />0~ <br /> <br />FEBRUARY 24, 1976 <br /> <br />TUESDAY <br /> <br />requested a refund of the difference between electric service charges <br /> <br />billed by the City and paid by Mr. Merricks~ based on the City's <br /> <br />commercial tariff, and the charges that would have been made under <br /> <br />the City's residential tariff, for location at 205 Broad Street~ from <br /> <br />February 14~ 1975~ the date Mr. Merricks~ of his own volition, <br /> <br />combined or consolidated previously-separated electric service connections <br /> <br />serving his residence and a small apartment unit to the rear of his <br /> <br />residence~ Mr. Merricks stating that he did so on the assumption that <br /> <br />the combined service would continue to be billed under the City's <br /> <br />residential tariff and, thus~ would result in lesser electric service <br /> <br />costs at that location when, actually, the costs have been much greater <br /> <br />because the commercial tariff (with demand meter) became applicable. <br /> <br />Mr. Merricks contended that he made the change in good faith and that he <br /> <br />should have been forewarned and/or advised by the City that the commercial <br /> <br />tariff (with demand meter) would apply and, thus~ result in higher electric <br /> <br />service costs. After some discussion~ and upon motion (duly seconded and <br /> <br />unanimously carried), Council directed that Mr. Merricks be refunded the <br /> <br />difference to be determined by re-calcu1ating his electric consumption <br /> <br />under the residential tariff~ from February 14~ 1975 to March 1, 1976~ <br /> <br />with option afforded Mr. Merricks of separating the service for residential <br /> <br />tariff application or continuing on a combined basis and being subject to <br /> <br />the commercial tariff. <br /> <br />In response to Council's request from its February lOth (1976) meeting~ <br /> <br />City Manager Noland presented a tabulation reflecting electric service <br />
