<br />within sixty (60) days from the date the notice <br />of appeal was filed with the board. <br /> <br />An appeal stays all proceedings in furtherance <br />of the action appealed front unless the officer <br />from whom the appeal is taken certifies to the <br />board. after the notice of appeal shall have <br />been filed with him. that by reason of facts <br />stated in the certification a stay would, in his <br />opinion, cause imminent peril to life or <br />property. In such case of peril, proceedings <br />shall not be stayed otherwise than by restraining <br />order. which may be granted, upon due cs'e <br />shown, by the board or by a court of record <br />with written notice of such order to the officer <br />from whom the appeal is taken. <br /> <br />s-s Powers <br /> <br />The board shall have the following powers: <br /> <br />1. To hear and decide appeals where it is <br />alleged that there is error in any order, <br />requirement, decision, or determination made <br />by the Building Official or other officer of <br />the city government in the enforcement of <br />this ordinance or of any ordinance adopted <br />pursuant thereto. <br /> <br />1""""-"""""'- <br /> <br />2. To authorize upon appenl in specific <br />cases, variances from the terms of this <br />ordinance as will not be contrary to the <br />public interest where, owing to special <br />conditions, a literal enforcement of the <br />provisions of this ordinance will result in <br />undue hardship; provided, that the spirit of <br />this ordinance shall be observed and <br />substantial justice done. <br /> <br />In considering all proposed variances to this <br />ordinance, the board shall, before making any <br />finding in a specific case, first determine <br />that the proposed variances will not materially <br />increase the public danger of fire and safety, <br />nor materially diminish or impair established <br />property values within the surrounding area, <br />nor in any other respect impair the public <br />health, safety, morals, and general welfare. <br /> <br />In authorizing a variance, t~e board may <br />impose such conditions regarding the location, <br />character and other features of the proposed <br /> <br />~ <br />
