<br />land-disturbing activity as it may deem <br />necessary in the public interest, an~:': may <br />require a guarantee or bond to insure that <br />there is being and will continue to be <br />compliance with the conditions. <br /> <br />5-6 Required vote for reversal of decisions. etc. <br /> <br />The concurring vote of three members of the <br />board shall be necessary to reverse any order, <br />requirement, decision, or determination of <br />the Building Official, to decide in favor <br />of the applicant any matter it is required <br />to pass under this ordinance, or to effect <br />any variance from the requirements in this <br />ordinance. <br /> <br />5-7 Appeals from decisions of board. <br /> <br />Section 6. <br /> <br />6-1 <br /> <br />6-2 <br /> <br />Any person or persons, jointly or severally, <br />aggrieved by any decision of the board, or any <br />taxpayer, or any officer, department, or agency <br />of the City, within thirty days after the filing <br />of the decision of the board in the office of <br />the board, but not thereafter, may present to <br />a court of record a petition duly verified, <br />setting forth a claim that such decision is <br />illegal, in whole or in part, and specifying <br />the grounds of alleged illegality, whereupon <br />such decision of said board shall be subject <br />to review as provided by law. <br /> <br />Penalties, Iniunctions, and Other LeRal Actions. <br /> <br />A violation of this ordinance shall be deemed a <br />misdemeanor and, upon conviction, the violator <br />shall be subject to a fine not exceeding five- <br />hundred ($500.00) dollars and/or twelve (12) <br />months imprisonment for each violation. Each <br />day the violation shall continue shall constitute <br />a separate offense (see Martinsville City Code <br />Section 1-6). <br /> <br />The Building Official may apply to the Circuit <br />Court of the City of Martinsville for injunctive <br />relief to enjoin a violation or a threatened <br />violation of this ordinance, without the <br />necessity of showing that there does not exist <br />an adequate remedy at law. <br /> <br />6-3 <br /> <br />The Commonwealth's Attorney shall, upon request <br />of the Building Official, take legal action to <br />enforce the provisions of this ordinance. <br />
