Attorney Frith then pointed out that <br /> <br />the Commission has considered the request on four separate occasions and on each <br /> <br />occasion has recommended approval of the request, with but one member voting <br /> <br />against only one time, viz., on the action reported in the Commission's July 18th <br /> <br />recommendation. During the course of the foregoing questioning and presentation, <br /> <br />some questions arose as to the interpretation and/or implication of the <br /> <br />"Transitional Open Space" connotation attached to the area in question by the <br /> <br />adopted 1995 Land-Use Plan. At the conclusion of this hearing, upon recommendation <br /> <br />of Mayor Boaz, Council called for a special meeting to be conducted by Council, <br /> <br />jointly with the City's Planning Commission, at a time to be determined by Mayor <br /> <br />Boaz and City Manager Noland, to be held at the site of petitioner's property on <br /> <br />Rives Road, for the purpose of viewing said property and reviewing with petitioner <br /> <br />the plans for development thereof as well as relating same to the physical <br /> <br />surroundings and the objections thereto registered. <br /> <br />In tentative acceptance of the Planning Commission's report and recommendation <br /> <br />(dated August 22, 1975), Council called for a duly-advertised public hearing to <br /> <br />be conducted by Council at its forthcoming October 14th (1975) meeting on a request <br /> <br />(dated June 24, 1975) filed by Nationwide Homes, Inc., requesting the following <br /> <br />rezoning of its property located east of Brookdale Road (to the rear of City-owned <br /> <br />property in East Martinsville and on the south side of the Carolina & Northwestern <br /> <br />Railroad, near Griggs Road): <br /> <br />(a) Approximately 65 acres from ~'R-9 Residential" to "R-6 Residential"; <br />and <br /> <br />(b) Approximately seven and one-half acres, adjacent to and paralleling <br /> <br />the Carolina & Northwestern Railway Company's right-of-way, to <br /> <br />"M-3 Industrial". <br />
