<br />'- <br /> <br />TUESDAY <br /> <br />AUGUST 26, 1975 <br /> <br />-- <br /> <br />reside or own property in the adjacent area and on Sheraton Court, all of whom <br /> <br />expressed vigorous opposition to the requested rezoning and to the proposed conduct <br /> <br />of any business operation onfue south side of Rives Road in the area in question and <br /> <br />in contiguous areas, citing noise-and-sight "pollutions" aS,one reason for registered <br /> <br />objections as well as anticipated depreciation of residential property values. Mr. <br /> <br />Charles Barnes, an Associate of Wiley & Wilson, Consulting Engineers, and Project <br /> <br />Director for the City's "1995 Land-Use Plan" prepared for the City and recently adopted <br /> <br />by City Council, appeared before Council and stated that the Plan, as related to the <br /> <br />area in question, is predicated upon the assumption that industrial operations would <br /> <br />remain to the west of Rives Road and, conversely, projected usage of property on the <br /> <br />south side of Rives Road would be of residential nature. Mr. Barnes, in addition, <br /> <br />recommended that the properties on the south side of Rives Road remain residentially <br /> <br />zoned; otherwise, rezoning the tract in question to industrial usage would constitute <br /> <br />"spot zoning". Attorney Kiser then pointed out that, of the information being presented <br /> <br />to Council at this hearing, all had been previously presented to the Planning Commission <br /> <br />with the exception of statements and recommendations herein presented by Mr. Barnes, of <br /> <br />Wiley & Wilson. In response to further questioning by Attorney Kiser, Assistant City <br /> <br />Manager-Public Works Director George W. Brown reviewed the background history of the <br /> <br />development of Rives Road (Extension) as an industrial access construction project to <br /> <br />connect with Route 220 South in Henry County, indicating that this street was <br /> <br />constructed generally for residential usage traffic and would require re-building to <br /> <br />accomodate heavy truck traffic. In response to inquiry from Attorney Kiser, Mr. Irving <br /> <br />R. McGhee, Traffic & Planning Director and Ex-Officio Secretary to the Planning <br /> <br />Commission, stated that the July 18th (1975) report and recommendation (of approval <br /> <br />of petitioner's request for rezoning) from the Planning Commission resulted from action <br /> <br />by the Commission in which, of its nine members, eight were present when the vote for <br /> <br />recommended approval was taken, with three of the eight members present abstaining from <br /> <br />voting, with one member voting against recommending approval, and with the remaining <br /> <br />- <br /> <br />,- <br />
