Kiser, counsel for the opponents, introduced the following statement of <br /> <br />opposition previously filed with the Planning Commission as well as the following <br /> <br />letter dated May 30, 1975 in opposition to the re-referral of the re-filed rezoning <br /> <br />request (re-dated May 27, 1975) to the Planning Commission: <br /> <br />We the undersigned oppose the rezoning of the corner of Rives Road Ext. <br />& Drewy Road to M-3 Industrial from R-9 Residential. It is our position that the taint <br />stemming from the original action would carryover to the reapplication or <br />resubmission, and any action by the Planning Commission at this time would be <br />subject to the same objections interposed by the opposition at the Council <br />meeting on May 27, 1975. It is our position that the application withdrawal <br />should be treated as a denial and that no new application could be submitted <br />until the expiration of the time limit set forth in the ordinance, which is, I <br />believe, six months. <br /> <br />Attorney Kiser then inquired of petitioner as to why an "M-l Industrial" zoning, rather <br /> <br />than an "M-3 Industrial" zoning, is being sought, meanwhile inquiring further as to the <br /> <br />contemplated nature of the business operation and plans, if any, for expansion. <br /> <br />Attorney Kiser than introduced twelve citizens and/or property owners present, who <br />
