<br />GO <br />0~ <br /> <br />TUESDAY <br /> <br />MAY 27, 1975 <br /> <br />Under date of May 22, 1975, the Martinsville Planning Commission recommended <br /> <br />approval by Council of a petition filed by Nationwide Homes, Inc., (under <br /> <br />date of April 8, 1975) requesting the rezoning of pr?perty situated on the <br /> <br />south side of Rives Road Extension, at its intersect~on with Drewry Road, <br /> <br />from "R-9 Residential" to "M-3 Industrial". ~1r. Jackson L. Kiser, Attorney <br /> <br />at Law and Counsel for a number of property owners in the area of the property for <br /> <br />which rezoning was requested, appeared before Council and requested that City <br /> <br />Council reject the Planning Commission's report and, in effect, deny the <br /> <br />request of petitioner on the premises that (1) the land requested rezoned <br /> <br />has been a buffer separation between residentially-zoned properties and <br /> <br />non-residentially-zoned properties in the area; and (2) the Planning Commission's <br /> <br />processing of this petition is not valid in that the Chairman (Mr. James H. <br /> <br />Ford, Attorney at Law) of the Commission, although he has made full disclosures <br /> <br />and has abstained from officially taking part in the processing of the petition, <br /> <br />is legal counsel for petitioner in this case although, as pointed out by the <br /> <br />Chairman (Mr. Ford), there is no prohibition against such representation. In <br /> <br />addition, the Planning Commission Chairman (Mr. Ford) agreed to withdraw as <br /> <br />legal counsel for petitioner and, furthermore, upon the advice of City Attorney <br /> <br />Worthy, in order to avoid the possibility of future litigation, Nationwide <br /> <br />Homes--through its President, Mr. James W. Severt--officially and formally <br /> <br />withdrew the petition. Subsequently, during the course of this meeting, <br /> <br />Mr. Severt filed a new petition under date of May 27, 1975, requesting the <br /> <br />rezoning of the aforementioned property from "R-9 Residential" to "M-3 <br /> <br />Industrial", which petition Council referred to the Planning Commission for <br /> <br />its consideration and recommendation. <br />
