<br />TUESDAY <br /> <br />NOVEMBER 25, 1980 <br /> <br />Greene voting against the adopting motion, stating that the proposed ordinance would constitute <br /> <br />.--- <br /> <br />bad legislation and, further, that he is in agreement with Police Chief Roop and with Assistant <br /> <br />Commonwealth's Attorney J. Randolph Smith on the need previously recommended by them for <br /> <br />detailed record-keeping by such dealers), Council adopted said proposed ordinance, as follows: <br /> <br />WHEREAS, a need has arisen to regulate dealers in precious metals and jewels <br />within the City of Martinsville; now, therefore, <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in regular <br />session held on November II, 198a, as follows: <br /> <br />I. No dealer, whether itinerant or permanent as hereinafter defined, <br />may purchase gold, silver, platinum, gems, or semi-precious stones <br />without a license as provided herein. <br /> <br />2. A dealer within the meaning of this ordinance is defined as a <br />person, firm, or corporation who shall engage, in the City of <br />Martinsville, in the business of purchasing gold, silver, platinum, <br />gems, or semi-precious stones, except from licensed manufacturers <br />or wholesalers of such items. Dealers who own the premises at <br />which the aforesaid business is conducted, or who have a lease of <br />at least one year's duration on the premises at which said business <br />is conducted, shall be deemed to be permanent dealers. Any <br />dealer who does not meet any of the aforesaid criteria for a permanent <br />dealer shall be deemed to be an itinerant dealer. <br /> <br />3. Licenses shall be issued by the Commissioner of Revenue to any <br />person able to produce satisfactory evidence of good character, <br />which license shall designate the premises on which the licensee <br />shall conduct the aforesaid business and specify the date or <br />dates upon which the business may be conducted. A fee of $37.50 <br />for a period of one year shall be charged for said license. <br /> <br />4. The license issued hereunder shall be a personal privilege and <br />shall not be transferrable, nor shall there be any abatement of <br />the tax upon such license by reason of the fact that the licensee <br />shall have exercised the privilege for any period of less than <br />that for which it was granted. The license shall at all times <br />be kept publicly exposed by the licensee on his business premises. <br /> <br />S. Any false statement made on the application form voids the license <br />ab initio. Every person so licensed shall, at the time of the <br />issuance thereof and before the same shall be operative, enter <br />with either one corporate or two personal sufficient sureties <br />into a joint and several recognizance to the City in the penal <br />sum of $25,000.00 conditioned upon due observance of the terms <br />of this ordinance. <br /> <br />6. If any person shall be aggrieved by the misconduct of any licensee <br />and shall recover against him therefor, such person may, after the <br />return unsatisfied, either in whole or in part, of any execution <br />upon such judgment, maintain actions in his own name upon the <br />aforesaid bond. <br />
