<br />(1) adopted the following resolution authorizing City Attorney
<br />Worthy to institute and conduct condemnation proceedings
<br />on behalf of the City of Martinsville to acquire land from
<br />The Lester Group, Inc., for the site of the aforesaid water
<br />storage facility:
<br />
<br />WHEREAS, in order to meet the needs of its citizens
<br />for an adequate supply of water, both for the purposes
<br />of consumption and fire protection, it is deemed
<br />necessary by the Council of the City of Martinsville,
<br />Virginia, to construct a water storage tank with a
<br />capacity of one million gallons; and,
<br />
<br />WHEREAS, in order to have a suitable site for said tank,
<br />it is necessary for the City to acquire fee simple title
<br />to a portion of the land owned by The Lester Group, Inc.,
<br />in the City of Martinsville, upon which said tank is to be
<br />constructed, said land to be acquired in fee simple consisting
<br />of all that certain lot or parcel of land lying in the City of
<br />Martinsville, Virginia, containing 24,658 square feet of land
<br />as shown on a plat of survey for The Lester Group, Inc., by
<br />J. A. Gustin & Associates, dated August 4, 1980, a copy of
<br />which is attached hereto and made a part of this resolution,
<br />and being more particularly described according to said
<br />survey as follows:

<br />BEGINNING at an existing iron pin located in the West
<br />right of way line of a 41 foot wide gravel road space
<br />with its intersection with another unnamed road as
<br />shown on the aforesaid map, said point also marking
<br />the southeast corner of Lot 1, thence N. 330 55' 57"
<br />W. 148.27 feet to an existing iron pin, thence N. 55026'32"
<br />E. 179 feet to a point in Rufus Hairston's line, thence
<br />S. 380 56' 17" E. 119 feet to the aforementioned 41 foot
<br />wide gravel road space, thence with said road space
<br />S. 460 34' 16" W. 192 feet to the point of beginning; and,
<br />
<br />WHEREAS, pursuant to authority previously granted by a resolution
<br />of this Council, agents of the City of Martinsville have
<br />previously made a bona fide but ineffectual effort to purchase
<br />said land from The Lester Group, Inc., and were unable to do so
<br />because of inability to agree upon the purchase price; now,
<br />therefore,

<br />BE IT RESOLVED by the Council of the City of Martinsville,
<br />Virginia, in regular session held on October 14, 1980, that
<br />David B. Worthy be, and he hereby is, appointed Attorney for the
<br />City of Martinsville, Virginia, in this matter; and,
<br />
<br />BE IT FURTHER RESOLVED by said Council that the said David B.
<br />Worthy be, and he hereby is, authorized to bring and conduct
<br />condemnation proceedings to acquire said land in the name of and
<br />on behalf of the City of Martinsville, Virginia, and as its
<br />Attorney to make oath to the condemnation petition, all in accord
<br />with the statutes in this Commonwealth in such cases made and
<br />provided.
