<br />l~ f' .. <br />, " <br />t 1;,..1 l <br /> <br />TUESDAY <br /> <br />MAY 13, 1980 <br /> <br />debris therefrom regularly and especially after heavy rainfalls, that the City enlarge <br /> <br />(in depth) and dredge such ditches (particularly the one behind Patrick Henry School), <br /> <br />and that the City enlarge the drain line under Stratford Court. These suggestions <br /> <br />were referred to the Public Works Department. <br /> <br />Upon motion, duly seconded and unanimously carried, Council adopted the following <br /> <br />resolution appointing the firm of McGuire, Woods & Battle as bond counsel to the City <br /> <br />for legal services relating to the authorization, issuance and sale of the City's <br /> <br />bonds for the City's proposed Ridgeway hydro-electric project: <br /> <br />WHEREAS, the Council of the City of Martinsville, Virginia (the <br />"City"), is studying the feasibility of issuing the City's <br />bonds to finance the cost of acquiring, constructing and <br />equipping a hydro-electric power generation facility and other <br />related facilities; and <br /> <br />WHEREAS, the City Council deems it necessary and appropriate to <br />retain bond counsel to advise the Council in connection with legal <br />matters relating to the authorization, issuance and sale of the <br />City's bonds for such purpose; and <br /> <br />WHEREAS, the City Council has received a proposal from the legal <br />firm of McGuire, Woods & Battle, Richmond, Virginia, relating to <br />the furnishing of services as bond counsel to the City as well <br />as this firm's letter disclosing, pursuant to the Virginia <br />Conflict of Interest Act, representation by same of governmental <br />boards, bodies, agencies and political subdivisions in Virginia <br />and membership by this firm's partners and associates, or their <br />spouses, on governmental boards, bodies or agencies in Virginia; <br />now, therefore, <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, <br />that: <br /> <br />1. Said City Council hereby designates the legal firm <br />of McGuire, Woods & Battle as bond counsel to the <br />City, to serve in the aforesaid capacity upon the <br />terms set forth in letter referred to above; <br />2. Said City Council hereby determines that it is not <br />in the public interest to retain the services of bond <br />counsel, for said purpose, through competitive <br />bidding; and <br />3. This resolution shall take effect immediately. <br />
