<br />(" /'1 <br />~ ) ~ <br /> <br />TUESDAY <br /> <br />MAY 13, 1980 <br /> <br />with the matter brought before Council by Mr. Lester on April 22, 1980, viz., <br /> <br />for assistance toward diverting and/or preventing surface water run-off from and <br /> <br />away from this firm's Roy Street plant to avoid a recurrence of recent flooding <br /> <br />conditions which damaged this plant or its contents. In addition, these <br /> <br />gentlemen requested that Council not dismiss this matter, despite the City's <br /> <br />administrative report that the City has no responsibility in this situation, with <br /> <br />petitioners contending that this is a problem common to both the City and the <br /> <br />Lacy Corporation until proved otherwise through additional study and by an <br /> <br />independent consultant's findings. Meanwhile, Assistant City Manager-Public Works <br /> <br />Director George W. Brown reported that a recent inspection of the drainage basin <br /> <br />indicates that no major changes in the basin environs have taken place in recent <br /> <br />years to cause increasing water run-off but, rather, there are reasons to believe <br /> <br />that the 24" drainage line under Lacy's Roy Street plant has deteriorated to the <br /> <br />extent it can no longer function as initially designed. In addition, Mr. Brown <br /> <br />noted that, inasmuch as it is deemed not feasible to replace this line, an alternative <br /> <br />solution would require the installation of adequate drain piping around the plant <br /> <br />as well as some land regrading. Council concurred in Councilman West's suggestion <br /> <br />that City Attorney Worthy research the City's policy in such matters, including <br /> <br />legal precedents; and, too, Council concurred in Vice-Mayor Cole's suggestion that <br /> <br />re-diversion and re-channelling possibilities be explored and studied. <br /> <br />In a companion matter, Mr. Franklin P. Foard, of 700 Zee Street, informed Council <br /> <br />that flooding in the Zee Street-Stratford Court-Jefferson Street area appears to <br /> <br />have become more severe in recent years, with Mr. Foard suggesting that the City <br /> <br />inspect drainage ditches in the area on a regular schedule, that the City remove <br />
