Kiser, Attorney at Law, substituting for Mr, John L, Gregory, III, Attorney at Law), Council scheduled a duly~dvertised public hearing for Council~s forthcoming November 13th meeting on this company~s petition (referred to the Planning Commission from Council's September 20th meeting and on which the Planning Commission will conduct its public hearing on NOvember 6th) seeking the rezoning to "'M,,2 IndustrialM of six lots (or such portions thereof not already so zoned) owned by petitioner and fronting Maryland and Lavinder Street. With Councilman West abstaining and with all other members of Council voting in the affirmative on a referral motion, Council referred to the Planning Commission, with authority to approve or disapprove, a petition filed by Fralin & Waldron, Inc., seeking a modification of the Special~se Permit issued to petitioner under date of May 22, 1979, to increase from 94 units to 101 units (with attendant changes in parking and in other facets related thereto) for petitioner~s Spruce Village Apartments Project (for the elderly and/or handicapped), with one of the 101 units to be reserved for the complex manager. Council was informed that the 1977~78 Property Tax Rebate (authorized by Council on November 28, 1979 and funded in the adopted 1979~80 City Budget) project has been completed, details of which were set forth in the Finance Director's memorandum report to City Manager Noland under date of September 28, 1979.
