<br />,----, ~ <br />". ,j <br /> <br />TUESDAY <br /> <br />JUNE 26, 1979 <br /> <br />economically feasible at this time and, consequently, recommended that the petition be approved. <br /> <br />Appearing before Council in behalf of the petitioners was Mr. Benjamin R. Gardner, Attorney at <br /> <br />Law, who indicated that--on the basis of prior testimony by Messrs. Irving R. McGhee, Traffic <br /> <br />& Planning Director, Phillip Henry, City Engineer, and James B. Jones, Jr., Building Official-- <br /> <br />development of the street section in question is virtually impossible, that the street could <br /> <br />not meet highway department requirements, and, furthermore, approving his clients petition <br /> <br />would enable them to make tangible usage of their properties. In opposition to the petition was <br /> <br />Mr. William B. Muse, President of Martinsville Homebuilders, represented by Mr. Robert A. Williams, <br /> <br />Attorney at Law, who pointed out that Martinsville Homebuilders, as owner of certain property <br /> <br />along said G Street, would be adversely affected should the closing petition be granted, meanwhile <br /> <br />pointing out that closing of this section would present serious topographical problems, <br /> <br />particularly as to grade elevations for a First Street connection. In response to some <br /> <br />indication that action on this matter should be postponed, pending an on-site review of the <br /> <br />property, Attorney Gardner asked for an immediate decision thereon by Council. A motion by <br /> <br />Councilman West, seconded by Councilman Oakes, to accept the Planning Commission's recommendation <br /> <br />thereon and grant petitioners' request (and, thereby, order the closing of the G Street section), <br /> <br />was superseded by Councilman Greene's motion (seconded by Vice Mayor Cole) to defer action until <br /> <br />Council can view the street and the affected properties (at Council's forthcoming annual street <br /> <br />tour), which motion (to defer action) carried by a vote of three-to-two (Messrs. Greene, Cole, <br /> <br />and Hobson voting affirmatively, and Messrs. West and Oakes voting against the motion). <br /> <br />In tentative acceptance of the Planning Commission's recommendation (by report dated June 22, <br /> <br />1979) that Prilco Rentals' petition, seeking a rezoning (to "C-3") of property situated at the <br /> <br />intersection of Liberty Street and Clearview Drive, be granted, Council scheduled a duly- <br /> <br />advertised public hearing on this petition at Council's forthcoming July 24th meeting. <br />
