'-, <br /> <br />TUESDAY <br /> <br />MAY 22, 1979 <br /> <br />- <br /> <br />handicapped and/or elderly, Council unanimously (with the exception <br />of Councilman West, who abstained from voting because of his property <br />holdings in that area) accepted the Planning Commission's recommendations <br />thereon (dated April 20, 1979) and directed the issuance of the requested <br />permit, accompanied by an indication of the preferences expressed by <br />interested citizens present, including the Martinsville Senior Citizens <br />(as a group, represented by Mrs. Kathy Childress, Senior Citizens <br />Coordinator) for a "garden-type" facility, which preferences were <br />registered during the subsequent consideration by Council of the <br />application for a Special-Use Permit filed by Messrs. Clyde N. Eanes <br />and Bruce W. Hughes, hereinafter recorded under item "5" of this portion <br />of these minutes. Representing and speaking on behalf of Fralin & <br />Waldron were Messrs. Horace Fralin and Elbert Waldron, who outlined the <br />eligibility requirements for individual tenant subsidies as well as their <br />considerable experience, both ownership and managerial, in similar <br />projects elsewhere, meanwhile noting that their proposed project (as well <br />as that of Messrs. Eanes and Hughes) would be constructed and operated <br />under the funding requirements of the Virginia Housing & Development <br />Authority, which agency has allocated ninety-four units to Martinsville <br />for the handicapped and/or elderly and (that) the firm of Fralin & <br />Waldron has been given a "No.1" funding priority by that agency; and <br /> <br />-. <br /> <br />-, <br /> <br />(5) On an application for a Special-Use Permit, filed February 27, 1979, by <br />Messrs. Clyde N. Eanes and Bruce W. Hughes, t/a Spruced ale Manor, <br />(through their counsel, Attorney Ebb H. Williams, III), to allow for the <br />construction and operation of a "garden-type" 120-unit apartment complex <br />on the north side of Brookdale Road (to the rear of Lowe's Thrifty-Mart), <br />whose tenants would be only the handicapped and/or elderly, Council <br />unanimously (with the exception of Councilman West, who abstained from <br />voting because of his property holdings in that area) accepted the <br />Planning Commission's recommendations thereon (dated April 20, 1979) <br />and directed the issuance of the requested permit. The record notes <br />that City Attorney Worthy advised Council that its consideration and <br />action on both the Fralin & Waldron application and the Eanes-Hughes <br />application should be predicated solely on, and limited to, the City's <br />"Regulations for Special Types of Uses" as set forth in subsection "B" <br />of Section VIII of the City's Zoning Ordinance, being Appendix B of <br />the City Code. The record notes, also, that Council's consideration <br />and action on these two foregoing matters were predicated solely on, and <br />limited to, said regulations. <br /> <br />In tentative acceptance of the Planning Commission's recommendations for approval, Council <br /> <br />called for a duly-advertised public hearings to be conducted on the following matters, as <br /> <br />follows: <br /> <br />(I) <br /> <br />At Council's forthcoming June 12th meeting, on a petition submitted <br />(April 24, 1979) by Mr. H.
