<br />1 ~-.. <br /> <br />.l '--' <br /> <br />TUESDAY <br /> <br />OCTOBER 10, 1978 <br /> <br />...- <br /> <br />City Manager Noland, referring to the proposed City Charter amendment on which a special <br /> <br />election has been scheduled for December 19, 1978, informed Council that it now appears likely <br /> <br />that representatives of the U. S. Corps of Engineers can meet with Council at its forthcoming <br /> <br />October 24th meeting to discuss with Council not only the City's proposed hydro-electric dam <br /> <br />on Smith River but also such similar projects along this river, southeast of Martinsville, <br /> <br />as are being contemplated by the Corps of Engineers. Further, in connection with the City's <br /> <br />proposed project and with the heretofore-suggested Citizen's Committee, whose purpose would <br /> <br />-- <br /> <br />be to appraise the City's consulting engineers' report on said project and to advise Council <br /> <br />thereon, Council (by a recorded and unanimous vote) adjourned into an Executive Session to <br /> <br />consider the naming of members of such a committee, following which Session this matter was <br /> <br />continued. <br /> <br />Also, in the same Executive Session, the motion so authorizing including the purpose of being <br /> <br />apprised by City Attorney Worthy of two legal matters, Council was so apprised and, following <br /> <br />said Session, Council authorized the City Attorney to file appropriate responsive pleadings in <br /> <br />the cases of (1) the Henry County Public Service Authority vs. the City of Martinsville, <br /> <br />wherein said Authority is claiming the right to provide sewer service to the Golden Corral <br /> <br />Restaurant (now under construction just outside of the City, on Route 220 North; see Council <br /> <br />action of April 25, 1978) under terms of a contract between the City and the Authority and (2) <br /> <br />- <br /> <br />Donald C. Custer vs. the Martinsville Planning Commission wherein Mr. Custer seeks to overthrow <br /> <br />the Commission's recent denial of Mr. Custer's petition for a subdividing of his property at <br /> <br />Berkshire Place and Spruce Street. <br /> <br />Upon inquiry from City Manager Noland, Council authorized the City Manager to file a list of <br /> <br />capital improvements projects with the West Piedmont Planning District Commission pursuant, to <br /> <br />,- <br /> <br />some extent, with the Commission's request therefor as filed with Council on September 12, 1978. <br />
