<br />TUESDAY <br /> <br />FEBRUARY 28, 1978 <br /> <br />The City Manager, along with Vice-Mayor Cole and Electric Director Robert Corekin, <br /> <br />all of whom have attended and/or testified before legislative hearings on this <br /> <br />proposed legislation, pointed out that one of the key issues therein involves the <br /> <br />requiring or not requiring referenda at certain stages by the jurisdictional <br /> <br />members of an electric authority, with such a requirement being opposed by the <br /> <br />aforementioned cities and towns for the reason that, in addition to the great expense <br /> <br />involved (in preparing for and conducting referenda), such an authority could not <br /> <br />function in the event one or more member-jurisdictions failed to support a referendum <br /> <br />issue. Mr. Noland also pointed out that this position of opposition to such a <br /> <br />requirement is supported by legal counsel and bond counsel. Councilman West, <br /> <br />comparing the proposed "Electric Authorities" legislation with the approach con- <br /> <br />templated by the City, in its consideration some months ago of a proposed hydro.. <br /> <br />electric facility solely for the City, cited the need for the local public to know <br /> <br />that such proposed legislation, if the referendum requirement is not included fuerein, <br /> <br />will preempt any mandate the citizens might choose through the public referendum <br /> <br />process. <br /> <br />Council unanimously referred to the Planning Commission, for its consideration and <br /> <br />recommendation, an Application for a Special-Use Permit filed by Mr. Donald C. <br /> <br />Custer, seeking permission to construct fifteen apartment units at the corner of <br /> <br />Spruce Street and Berkshire Place on Lot No. 27, with which lot applicant seeks to <br /> <br />combine Lots Nos. 25 and 26, meanwhile noting that presently he already has five such <br /> <br />units on said Lot No. 27. <br /> <br />Council unanimously authorized the advancing of funds (in the amount of $674.50), in <br /> <br /> <br />anticipation of receiving a Federal-State grant of like amount in fiscal 1978-79, to <br /> <br /> <br />enable Mr. Jan C. Reed, Director of Court Services for the Juvenile & Domestic Relations <br /> <br /> <br />Court, of the twenty-first judicial district, to attend an advanced juvenile justice <br /> <br />management training seminar at the University of Nevada, June 4th to June 9th. <br />
