t,_ TUESDAY MAY 25, 1982 outside of the City, to whom water service is not available from the Henry County Public Service Authority (per the March 17th letter from the PSA's Executive Secretary, Mr. Robert W. Grant), Council unanimously authorized the extending of a City water main, and the execution by City Manager Edmonds (on behalf of the City) of a contract therefor, by which these petitioners can obtain City water service, subject to compliance by petitioners with the City's regulations governing the ex- tension of water and sewer service (outside of the City) and the providing of restrictive deed covenants and contract terms to assure that future usage will be compatible with the City's R-9 Residential zoning requirements, all in accordance with the Planning Commission's recommendations thereon. ...-... Council unanimously authorized the scheduling and construction of curb-and-gutter for that section of Smith Street between Beaver Street and Overland Ridge Avenue on a shared-cost basis and at the rate of 85~ per front foot, which rate--subsequently having been increased from to time as actual construction costs increased--was in effect on or before Feburary 25, 1975, at which time a petition was circulated for curb-and-gutter for several streets in the area, including all of Smith Street, but apparently the petition for Smith Street became segmented--as did the curb-and-gutter construction schedule therefor--and, as a result, it was deemed that the foregoing section of Smith Street would be constructed on a shared-cost basis only at the current rate of $2.90 per front foot, to which the property owners along this section objected, claiming that--because of the cited circumstances--they are entitled to the same cost rate (of 85~) as required of property owners along that section of Smith Street between Katherine Street and Overland Ridge Avenue.
