<br />t,_ <br /> <br />TUESDAY <br /> <br />MAY 25, 1982 <br /> <br />outside of the City, to whom water service is not available from the Henry County <br /> <br />Public Service Authority (per the March 17th letter from the PSA's Executive <br /> <br />Secretary, Mr. Robert W. Grant), Council unanimously authorized the extending of a <br /> <br />City water main, and the execution by City Manager Edmonds (on behalf of the City) <br /> <br />of a contract therefor, by which these petitioners can obtain City water service, <br /> <br />subject to compliance by petitioners with the City's regulations governing the ex- <br /> <br />tension of water and sewer service (outside of the City) and the providing of <br /> <br />restrictive deed covenants and contract terms to assure that future usage will be <br /> <br />compatible with the City's R-9 Residential zoning requirements, all in accordance <br /> <br />with the Planning Commission's recommendations thereon. <br /> <br />...-... <br /> <br />Council unanimously authorized the scheduling and construction of curb-and-gutter for <br /> <br />that section of Smith Street between Beaver Street and Overland Ridge Avenue on a <br /> <br />shared-cost basis and at the rate of 85~ per front foot, which rate--subsequently <br /> <br />having been increased from to time as actual construction costs increased--was in <br /> <br />effect on or before Feburary 25, 1975, at which time a petition was circulated for <br /> <br />curb-and-gutter for several streets in the area, including all of Smith Street, but <br /> <br />apparently the petition for Smith Street became segmented--as did the curb-and-gutter <br /> <br />construction schedule therefor--and, as a result, it was deemed that the foregoing <br /> <br />section of Smith Street would be constructed on a shared-cost basis only at the <br /> <br />current rate of $2.90 per front foot, to which the property owners along this section <br /> <br />objected, claiming that--because of the cited circumstances--they are entitled to the <br /> <br />same cost rate (of 85~) as required of property owners along that section of Smith <br /> <br />Street between Katherine Street and Overland Ridge Avenue. <br /> <br />Pursuant to a recent request from Council, Mr. Charles L.
