<br />.) <br /> <br />f:.; <br /> <br />TUESDAY <br /> <br />JULY 14, 1981 <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled this fourteenth day of July, 1981, that <br />the definition of "Home Occupation" under Section II of the Zoning <br />Ordinance of the City of Martinsville, Virginia, be--and is hereby-- <br />amended to read as follows: <br /> <br />HOME OCCUPATION: An occupation conducted in a dwelling unit, provided that: <br /> <br />1. No person other than members of the family residing on the premises shall be <br />engaged in such occupation. <br />2. The use of the dwelling unit for the home occupation shall be clearly incidental <br />and subordinate to its use for residential purposes by its occupants; and not <br />more than twenty-five (25%) percent of the first floor area of the dwelling unit <br />or eight hundred (800) square feet, whichever is the lesser, shall be used in <br />the conduct of the home occupation. <br />3. There shall be no exterior evidence that the property is used in any way other <br />than for a dwelling, except one (1) sign, not exceeding two (2) square feet in <br />area, non-illuminated, and mounted flat against the wall of the residence, may <br />be permitted. <br />4. No home occupation shall be conducted in any accessory building. <br />5. No outside display of goods or outside storage of equipment or materials used <br />in the home occupation shall be permitted. <br />6. Except for articles produced on the premises, no stock in trade shall be stored, <br />displayed or sold on the premises. <br />7. No traffic shall be generated by such home occupation in greater volumes than <br />would normally be expected in a residential neighborhood, such as would cause <br />congestion by encroachment on adjoining properties or block safe access to <br />adjoining properties. <br />8. Any need for parking generated by the conduct of such home occupation shall be <br />met on the premises, off the street and other than in a required front yard. <br />9. The use of the dwelling unit for home occupation shall be compatible with the <br />neighborhood. Incompatible uses are those uses which have characteristics <br />such as, but not limited to, odor, dust, noise, vibration, glare, fumes, or <br />electrical interference detectable to the normal senses off the lot and/or <br />other qualities not compatible to the character of the neighborhood. <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in regular <br />meeting assembled this fourteenth day of July, 1981, that sub-paragraph 3 of <br />Paragraph C.R9 of Section V (District Use Regulations) of the Zoning Ordinance <br />of the City of Martinsville, Virginia, be--and is hereby--amended to read as <br />follows: <br /> <br />3. Day nurseries operated as an incidental home occupation, caring <br />for not more than six (6) children, with an outdoor play area <br />equivalent to at least one hundred (100) square feet per child <br />and otherwise complying with requirements in the Home Occupation <br />definition. <br />
