<br />) -1 t3 <br />~~ <br /> <br />TUESDAY <br /> <br />NOVEMBER 22, 1983 <br /> <br />seeking the abandonment of certain right-of-way in front of his residence at 912 Bethel <br /> <br />Lane. There being no objections registered against this petition, Mayor Cole declared <br /> <br />the public hearing closed; whereupon, duly seconded and unanimously carried, Council <br /> <br />approved said petition by its adoption of the following ordinance: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled this twenty-second day of November, 1983, <br />that the unused portion of the City's right-of-way beyond 7~ feet <br />from the back of the curb in front of the Raymond Bennett residence <br />at 912 Bethel Lane be--and is hereby--abandoned, subject to the filing <br />with the Clerk of Martinsville City Circuit Court of an appropriate <br />plat reflecting the right-of-way hereby authorized abandoned. <br /> <br />Pursuant to duly-advertised public notice, Council conducted a public hearing on United <br /> <br />Virginia Bank's petition (previously approved by the Planning Commission) seeking the <br /> <br />closing and abandonment of four alleyways situated to the rear of petitioner's property <br /> <br />at East Church and Ellsworth Streets. Representing petitioner was Mr. Fred D. Smith, Jr., <br /> <br />Attorney at Law, who agreed (on behalf of his client) to retention by the City (as recom- <br /> <br />mended by the City's administrative staff) of certain right-of-way required for the Mul- <br /> <br />berry Road Extension project and its companion Ellsworth Street widening project. There <br /> <br />being no objections to this petition, Mayor Cole declared this public hearing closed; <br /> <br />whereupon motion, duly seconded, and with Councilman West abstaining from voting because <br /> <br />of his being a director of United Virginia Bank, all other members of Council voted to <br /> <br />grant petitioner's request, with revision thereto as agreed upon, by its adoption of the <br /> <br />following ordinance: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled this twenty-second day of November, 1983, <br />that four alleyways situated to the rear of United Virginia Bank <br />property at East Church and Ellsworth Streets, being off the west <br />side of Ellsworth Street between East Church Street and Mulberry Road <br />Extension and being between property owned by Leggett Realty Company <br />of Martinsville, Mr. G. N. DeShazo, Mrs. Mary Via, Mr. Lester V. <br />Draper, Mr. Mack R. Draper, and Mrs. June D. Arnoult, be--and are <br />hereby--abandoned, subject to the following stipulations: <br />
