<br />l3: <br /> <br />TUESDAY <br /> <br />JUNE 28, 1983 <br /> <br />-- <br /> <br />which amends Appendix B and adds Appendix F to the City's Terms and Conditions of Water <br /> <br />and Sewer Service(s). <br /> <br />Pursuant to action taken by Council at its June 14th meeting with regard to Prillaman & <br /> <br />Pace's request for a reinstatement of the exclusionary provision formerly afforded local <br /> <br />contractors on their "outside" contract gross receipts, Council unanimously adopted the <br /> <br />- <br /> <br />following ordinance (identifed as Ordinance No. 83-3) which so incorporates this pro- <br /> <br />vision by amending the City's 1983 Business-Professional-Occupational License Tax <br /> <br />Ordinance accordingly: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular session held on June 28, 1983, that Article III of the <br />City of Martinsville's Business, Professional, Occupational License <br />Tax Ordinance, 1983, be amended by adding to sub-paragraph (a) under <br />Paragraph 1 thereunder, the following words: <br /> <br />"provided that, however, until the license tax year in <br />which the aforesaid rate is rolled back to sixteen cents <br />per one hundred dollars of gross receipts, any such <br />person, firm, or corporation required to pay a local <br />license tax by the terms of this sub-paragraph shall be <br />permitted to exclude from his or its gross receipts (and <br />the payment of local business license taxes thereon) all <br />sums received from work performed outside the City's <br />corporate limits where the total amount of such sums <br />exceeds $10,000.00, if such work is or was performed <br />pursuant to the awarding of a contract therefor on a <br />competitive bid basis." <br /> <br />- <br /> <br />BE IT FURTHER ORDAINED that an emergency exists and that this amend- <br />ment shall be effective on and after June 28, 1983. <br /> <br />Council unanimously "tabled" on a temporary basis, pending receipt by City Attorney <br /> <br />Worthy of an opinion to be rendered by the Virginia Attorney General, a matter involving <br /> <br />the licensing and taxing of local private-duty nursing personnel under the City's 1983 <br /> <br />- <br /> <br />BP&O License Tax Ordinance, which such personnel Commissioner of Revenue J. Ronnie <br /> <br />Minter maintained should be licensed and taxed by the City as independent business <br />
