1. { f, TUESDAY JUNE 14, 1983 - Upon recommendation of City Attorney Worthy, Council unanimously adopted the following resolution authorizing Mayor Cole to execute an agreement between the City and the Henry County Public Service Authority, identified as an "arbitration agreement", which agreement (yet to be executed by the Public Service Authority) will bind the parties thereto by the decision of arbitrators recently appointed to settle the controversy between the City and the PSA concerning amounts due and payable by the City to the PSA, - if any, by virtue of the City's use of the PSA's sewage treatment plant's reserve capacity under the terms and conditions of the sewer agreement between the City and the PSA dated January 22, 1974: BE IT RESOLVED by the Council of the City of Martinsville, Virginia, in regular meeting held this fourteenth day of June, 1983, that The Honorable William C. Cole, Jr., Mayor of the City of Martinsville, be-- and he hereby is--authorized to execute on behalf of the City of Martinsville that certain arbitration agreement between the City of Martinsville and the Henry County Public Service Authority, a copy of which agreement is hereto attached and incorporated by reference as if it were set forth verbatim herein; and BE IT FURTHER RESOLVED by said Council that its Clerk be--and he hereby is--authorized to affix the City's seal to said agreement and attest same. Upon recommendation of the Piedmont Regional Community Services ("Chapter 10") Board, with the Board noting that among its membership there is presently no attorney, Council unanimously adopted the following resolution approving the employment by the Board of legal counsel, as named therein and under the conditions therein set forth: BE IT RESOLVED by the City Council of the City of Martinsville, Virginia, in regular session held on June 14, 1983, that, pursuant to the provisions of Section 11-41 of the 1950 Code of Virginia, as amended, that competitive negotiation for single or term contracts for professional services not expected to exceed $10,000 shall not be required; and BE IT FURTHER RESOLVED by said Council that the employment of John L. Gregory, III, as attorney for Piedmont Regional Community Services (Chapter 10) Board at an annual retainer of $1,200 be, and the same hereby is, approved.
