<br />( <br />L <br /> <br />TUESDAY <br /> <br />MAY 10, 1983 <br /> <br />--- <br /> <br />Sec. 8-6 <br /> <br />Burning trash or leaves banned during air pollution alert or <br />drought conditions. <br /> <br />It shall be a Class 1 misdemeanor to burn leaves, paper, trash, <br />or other material outdoors during the duration of an alert, <br />warning, or emergency stage in what is known as an "Air Pollution <br />Episode" when so proclaimed by the Executive Director of the <br />State Air Pollution Control Board or his designated representative <br />or during periods of extreme drought conditions which cause <br />forests, brush, or grass to become so dry or parched as to create <br />an extraordinary fire hazard when so proclaimed by the city fire <br />chief or city manager. <br /> <br />-- <br /> <br />Sec. 8-7 <br /> <br />Open burning - Conditions. <br /> <br />It shall be unlawful for any person to do any open burning out- <br />doors in the city unless the following conditions are complied <br />with: <br /> <br />a. Only paper, cardboard, leaves and tree, yard and garden <br />trimmings located on the premises of private residences <br />may be burned. <br /> <br />b. Any open burning of such material must take place on the <br />premises of the private residence where such material is <br />located. <br /> <br />c. Unless all material burned is fully contained within a <br />box or cage of metal or other non-combustible material <br />or consists only of leaves or of tree, yard and garden <br />trimmings in a pile less than five feet in diameter and <br />less than three feet in height, prior approval for the <br />burning must be obtained from the fire chief or an on- <br />duty fire department officer. <br /> <br />d. All open burning must be done between 9:00 A.M. and <br />8:00 P.M. <br /> <br />e. All open burning, except leaves from trees, shall be <br />done at least three hundred (300) feet from any occupied <br />building unless the occupant of the building has given <br />prior permission for burning closer to the building. All <br />open burning of leaves from trees shall be done at least <br />fifty (50) feet from any occupied building unless the <br />occupant of the building has given prior permission for <br />burning closer to the building. <br /> <br />f. All outdoor fires shall be attended at all times. <br /> <br />g. No person shall allow an outdoor fire to spread to the <br />lands or property of another or allow such fire to jeopar- <br />dize any building, machinery, or vehicle. <br />
