<br />18 <br /> <br />TUESDAY MAY 10, 1983 <br /> <br />h. If any officer of the city fire department finds that a <br />person engaged in outdoor burning is contributing to air <br />pollution and that such pollution creates an emergency <br />which requires immediate action to protect the public <br />health or safety, or that a person engaged in outdoor <br />burning is violating one or more conditions of this section <br />or is creating a fire hazard requiring immediate action to <br />protect the public health or safety, such officer shall <br />order the immediate extinguishment of such fire and the <br />immediate discontinuance of such burning. It shall be <br />unlawful to refuse to obey such an emergency order. <br /> <br />i. The provisions of this section shall not apply to outdoor <br />cooking with charcoal, provided such charcoal is fully con- <br />tained within a grill or fireplace of metal, brick, stone <br />or other non-combustible material and such grill or fireplace <br />is at least three feet from any combustible material. <br /> <br />j. Any open burning not allowed by this section may be done by <br />special permission of the fire chief and only in accordance <br />with applicable rules and regulations adopted by the State <br />Air Pollution Control Board pursuant to Sections 10-17.10 <br />through 10-17.30 of the Code of Virginia (1950). <br /> <br />k. Any violation of this section shall constitute a Class 1 <br />misdemeanor. <br /> <br />Council, also, (upon motion, duly seconded and unanimously carried) adopted the following <br /> <br />ordinance (as introduced April 26th and as revised) which amends the penalty provisions <br /> <br />of the City's utility services' terms and conditions: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, <br />Virginia, in regular session held on May 10, 1983, that <br />Sections 8.1 and 9.3 of the Terms and Conditions of Water <br />and Sewer Services and Sections 6.1 and 8.3 of the Terms <br />and Conditions of Electric Service, be and hereby are <br />amended as follows: <br /> <br />WATER AND SEWER SERVICE <br />ARTICLE VIII <br />Payment of Service Charges <br /> <br />Regular <br /> <br />Sec. 8.1 <br /> <br />Water meters will be read and service charges for both water <br />and sewer computed from those readings on a monthly basis. <br />
