In any instance of meter tampering <br />which results in meter registering more than 2% slow, the <br />City shall recalculate the monthly bills for a period of <br />twelve months, except in those cases where a meter error <br />can be documented for periods longer than twelve months. <br />Additionally, the provisions of Sec. 8.2 "Disconnection <br />for Fraud or Violation of the Rules" may be applied. <br /> <br />- <br /> <br />If the customer has been incorrectly billed because of <br />errors other than meter accuracy, the electricity used <br />during the entire period of incorrect billing will be <br />estimated, based on all known revelant facts and the billing <br />will be calculated based on the estimated use of the electri- <br />city. <br /> <br />Because of faulty title searches and/or lack of same when certain properties were <br /> <br />acquired by the present owners, Council authorized and directed the waiving of <br /> <br />penalties and interest accrued to the following delinquent property taxes for the <br /> <br />following tax periods: <br /> <br />(A) Second half of 1972 through first half of 1979, <br />Lot No.4, 29 Henry Street, now owned by Henry <br />County Investment Corporation; <br /> <br />(B) Year 1970, 318 Granville Street, now owned by <br />Mr. & Mrs. Fred Q. Keith; and <br /> <br />(C) Lot No. 26R, 402 Second Street, year 1963, now <br />owned by Mr. & Mrs. Vallie W. Hylton. <br /> <br />Council unanimously adopted the following resolution authorizing City Attorney <br /> <br />Worthy to apply to the United States Department of Justice for approval of the <br /> <br />amendment to Section 2 of Chapter 11 of the City Charter, as enacted by the 1981 <br /> <br />Session of the Virginia General Assembly: <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, <br />in regular session held on January 11, 1983, that the City Attorney be, <br />and he hereby is, authorized to apply to the U. S. Department of Justice <br />for the approval of the amendment to Section 2 of Chapter 11 of the <br />Martinsville City Charter enacted by the General Assembly of Virginia in <br />1981. <br />
