<br />44 <br /> <br />TUESDAY <br /> <br />OCTOBER 9, 1984 <br /> <br />the City might retain same on file and/or place on file with the State Health Depart- <br /> <br />ment in the event plant expansion should be found necessary at some time in the future). <br /> <br />Mr. Tom Crush, of Wiley & Wilson, indicated that such suspension would reduce the City's <br /> <br />current commission cost by some $45,000.00. <br /> <br />In order for the City to acquire certain lands and easements (not otherwise obtainable) <br /> <br />necessary to the construction and maintenance of the City's current Lavinder Street <br /> <br />- <br /> <br />Project, Council unanimously adopted the two following resolutions authorizing City <br /> <br />Attorney Worthy to institute and proceed with condemnation proceedings against E. L. <br /> <br />Stephens, III, et ai, and Elizabeth B. Dillard, et al: <br /> <br />CITY OF MARTINSVILLE v. E. L. STEPHENS, III, ET AL <br /> <br />In order to provide industrial access from Memorial Boulevard to certain <br />industrial concerns located to the west thereof in the City of Martins- <br />ville, Virginia, so as to relieve traffic congestion and unsafe conditions, <br />both for traffic and pedestrians on other existing streets in said City, it <br />is deemed necessary by the Council of the City of Martinsville, Virginia, <br />to extend Lavinder Street to intersect with Salem Street in said City, and, <br /> <br />WHEREAS, in order that said extension of Lavinder Street may be opened, <br />constructed, repaired and maintained, it is necessary for the City of <br />Martinsville to acquire fee simple title to a portion of the lands owned <br />by E. L. Stephens, III, and others, in the City of Martinsville, over <br />which said extension of Lavinder Street is to be constructed, and, in <br />addition to the land of E. L. Stephens, III, and others, to be acquired <br />in fee simple, said City needs to acquire a permanent construction ease- <br />ment in order to construct and maintain the proposed street, said land <br />as being shown on Sheet #2 of Plans of Lavinder Street Improvements and <br />Extensions as prepared by the City of Martinsville, Engineering Division, <br />dated October 28, 1983, a copy of which is on file in said Engineering <br />Division office, and a copy of which is attached hereto as a part hereof, <br />with the land to be acquired in fee simple being outlined in red on said <br />plan, and the land to be subjected to said construction easement being <br />outlined on said plan in orange, with said land to be acquired in fee <br />simple being more particularly described as follows: <br /> <br />Being as shown on Sheet #2 of Plans of Lavinder Street <br />Improvements and Extension as prepared by the City of <br />Martinsville Engineering Division, dated October 28, <br />1983, a copy of which is on file in said Engineering <br />Division Office,and lying on both sides of the right of <br />way centerline and extending from the west end of the <br />existing Lavinder Street right of way to the dividing <br />property line between the herein grantor and the heirs <br />of William Riley Bannister and being all that land <br />
