<br />148 <br /> <br />TUESDAY <br /> <br />OCTOBER 9, 1984 <br /> <br />between said centerline and the north property line of <br />the said grantor right of Approximate Station 17+86 and <br />along said property line to a point right of approximate <br />Center Line Station 23+80; and, all that land between <br />said center line and 26 feet left of approximate Station <br />18+23 and along the proposed right of way line of <br />Lavinder Street extended to a point 26 feet left of <br />approximate Center Line Station 23+69 and containing .67 <br />acre, said land to be subjected to said construction <br />easement being shown on said plan as outlined in orange <br />containing approximately .40 acre, all of the aforesaid <br />parcels of land being a portion of the same lanu <br />acquired by E. L. Stephens, III, et als, from J. Robert <br />Gregory, Executor by deed dated February 7, 1958 and <br />duly of record in the Clerk's Office of the Circuit <br />Court of the City of Martinsville, Virginia, in Deed <br />Book 89, at page 827, and, <br /> <br />WHEREAS, pursuant to authority previously granted by a resolution of this <br />Council, agents of the City of Martinsville have previously made a bona <br />fide but ineffectual offer to purchase said land and easement from the <br />said E. L. Stephens, III, and others, and were unable to do so because of <br />inability to agree upon the purchase price, <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Martinsville, <br />Virginia, in regular session held on October 9, 1984, that David B. Worthy <br />be, and he hereby is, appointed attorney for the City of Martinsville, <br />Virginia,in this matter, and, <br /> <br />BE IT FURTHER RESOLVED by said Council that said David B. Worthy be, and <br />he hereby is, authorized and directed to bring and conduct condemnation <br />proceedings to acquire said land and easement in the name of and on <br />behalf of the City of Martinsville, Virginia, and its attorney to make <br />oath to the condemnation petition, all in accord with the statutes in <br />this Commonwealth and in such cases made and provided. <br /> <br />CITY OF MARTINSVILLE v. ELIZABETH B. DILLARD, ET AL <br /> <br />In order to provide industrial access from Memorial Boulevard to certain <br />industrial concerns located to the west thereof in the City of Martins- <br />ville, Virginia, so as to relieve traffic congestion and unsafe conditions, <br />both for traffic and pedestrians on other existing streets in said City, <br />it is deemed necessary by the Council of the City of Martinsville, Virginia, <br />to extend Lavinder Street to intersect with Salem Street in said City, and, <br /> <br />WHEREAS, in order that said extension of Lavinder Street may be opened, con- <br />structed, repaired and maintained, it is necessary for the City of Martins- <br />ville to acquire fee simple title to a portion of the lands owned by <br />Elizabeth B. Dillard, and others, in the City of Martinsville, over which <br />said extension of Lavinder Street is to be constructed, and, in addition to <br />the land of Elizabeth B. Dillard, and others,to be acquired in fee simple, <br />said City needs to acquire a permanent construction easement over portions <br />of the remaining lands of Elizabeth B. Dillard, and others, said lands being <br />
