<br />as prepared by the City of Martinsville, Engineering Division, dated
<br />October 28, 1983, a copy of which is on file in said Engineering Division
<br />office and a copy of which is attached hereto as a part hereof, with the
<br />land to be acquired in fee simple being outlined in red on said plan, and
<br />the land to be subjected to said construction easement being outlined on
<br />said plan in orange, with said land to be acquired in fee simple being
<br />more particularly described as follows:

<br />Beginning at the southeastern corner of property belonging
<br />to the heirs of William Riley Bannister, said corner being
<br />the common corner between the William Riley Bannister
<br />property, property of E. L. Stephens, III, et als, and Lot
<br />'D' belonging to James Howard Hairston which fronts the
<br />south side of Salem Street; thence with the property line
<br />of the William Riley Bannister property and the E. L.
<br />o
<br />Stephens, III property S. 66 00' 00" W. 52.71 feet to a
<br />point in the proposed west right of way line of the afore-
<br />said new Lavinder Street; thence with that line, said line
<br />being a curve to the right described with a chord of that
<br />curve to N.80 48' 24" W. 79.59 feet to a point; thence N.
<br />20 15' 00" W. 88.95 feet to a point; thence with the north
<br />terminus of said proposed Lavinder Street N. 870 45' 00" E.
<br />58.04 feet to a point; thence with the east right of way
<br />line of the proposed Lavinder Street S. 20 15' 00" E.
<br />148.47 feet to the point of beginning and containing
<br />approximately 9,090 square feet of land, said land to be
<br />subjected to said construction easement being shown on
<br />said plan as outlined in orange, containing approximately
<br />11,625 square feet, all of the aforesaid parcels being a
<br />portion of the same land acquired by William Riley
<br />Bannister by that certain deed dated July 14, 1955, from
<br />William Riley Bannister, and others, being the heirs at
<br />law of Elizabeth Bannister, which deed is duly of record
<br />in the Clerk's Office of the Circuit Court of the City
<br />of Martinsville, Virginia in Deed Book 41 at page 27,
<br />the said William Riley Bannister having died intestate,
<br />his heirs at law being his brothers and sisters, all of
<br />whom are also deceased, so that the owners of said
<br />property are the descendants of the brothers and sisters
<br />of the said William Riley Bannister, said descendants
<br />being Elizabeth B. Dillard, and others, and
<br />
<br />WHEREAS, pursuant to authority previously granted by a resolution of this
<br />Council, the agents of the City of Martinsville have previously made a
<br />bona fide but ineffectual offer to purchase said land and easements from
<br />the said Elizabeth B. Dillard, and others, and were unable to do so be-
<br />cause of inability to agree on the purchase price primarily by reason of
<br />the fact of the impossibility of ascertaining the identity of all of
<br />the said owners of said property,
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Martinsville,
<br />Virginia, in regular session held on October 9, 1984, that DavidB. Worthy
<br />be, and he hereby is, appointed attorney for the City of Martinsville,
<br />Virginia, in this matter, and,
