<br />3 <br /> <br />TUESDAY <br /> <br />JULY 24, 1984 <br /> <br />a proposed resolution was introduced and read publicly whereby, if adopted, the contro- <br /> <br />versy which recently arose over citizen objections to programming changes effected and/or <br /> <br />contemplated by Martinsville Cablevision and Martinsville Cablevision's rights and duties <br /> <br />under its franchise granted by the City would be resolved and with which resolution Martins- <br /> <br />ville Cablevision is in accord. After some discussion of this proposed resolution (fol- <br /> <br />lowing its introduction and motion--duly seconded--to adopt), with Councilman Groden <br /> <br />..- <br /> <br />expressing his concern with possible future programming changes by Martinsville Cablevision <br /> <br />by supplanting present "basic service" television stations with ever-increasing independent <br /> <br />stations and transferring the supplanted service channels to a "tier" category (rates for <br /> <br />which City Council has no control over) at increased costs to subscribers. Councilman <br /> <br />Groden also questioned the validity of reported survey data by which, under regulations <br /> <br />of the Federal Communications Commission, Martinsville Cablevision is now required to <br /> <br />"carry" an independent television station located in Greensboro, North Carolina, as is a <br /> <br />Danville cablevision company after it had contested without success the data and require- <br /> <br />mente On a call for the vote on adopting the resolution, all members of Council--with the <br /> <br />thus, the motion carried. The adopted resolution follows: <br /> <br />exception of Councilman Groden, who voted "No"--voted in favor of adopting said resolution; <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, in <br />regular session held on July 24, 1984, that the controversy that has <br />arisen with Martinsville Cablevision concerning its rights and duties <br />under its franchise be settled according to the following terms and con- <br />ditions: <br /> <br />1. Station WTTG will be moved from the basic service to the super <br />service in order that station WGGT may be carried on the basic <br />service (which is mandated by FCC Regulations), station WGN will <br />be returned to the super service, and all of the aforesaid <br />stations, and all other stations and services that were being <br />carried on July 1, 1984, either on the basic service or the <br />super service, will be carried by Martinsville Cablevision for <br />the duration of the current term of its present franchise, sub- <br />ject to its right, which the City of Martinsville recognizes, <br />to change the rate charged for the super service, and, if deemed <br />advisable by Martinsville Cablevision, to divide said super ser- <br />vice into two or more tiers of services, and to charge a separate <br />rate for each of said tiers. <br />
