<br />,21 <br /> <br />TUESDAY <br /> <br />FEBRUARY 28, 1984 <br /> <br />-, <br /> <br />In response to Mayor Cole's inquiry regarding procedures and recourses set forth in <br /> <br />the BOCA Fire Prevention Code, last updated for the City by Council on October 26, 1982, <br /> <br />and the enforcement of the provisions thereof, particularly, for example, in the case of <br /> <br />Snow's Sandwich Shop (owned and operated by Mr. Allen S. Mayhew) which has been adjudged <br /> <br />as being notin compliance with some of the requirements of the Fire Prevention Code and, <br /> <br />on December 7, 1983, was ordered to so comply within ninety days (at a cost to Mr. Snow <br /> <br />estimated at $5,000.00), City Manager Edmonds reported that consistently-uniform enforce- <br /> <br />ment of the requirements of this code began soon after its last updating and that, at the <br /> <br />last updating, Council was apprised of the effects of such enforcement (which was lacking <br /> <br />in uniformity and consistency prior to said updating) and of the revisions then adopted. <br /> <br />City Manager Edmonds further reported that, of the thirty-eight local restaurants inspec- <br /> <br />ted, twenty-eight have come into compliance (some at considerable expense) whereas <br /> <br />several are proceeding to comply and two or more are seeking "relief" through means of <br /> <br />variances which can be granted by the City's Board of Appeals, in its discretion. Mr. <br /> <br />Edmonds also pointed out that Mr. Mayhew has this avenue available to him, if he desires <br /> <br />some variance or if he desires more time to meet the requirements (if granted by the <br /> <br />Appeals Board) or if he desires more time (if granted by the Appeals Board) to decide <br /> <br />whether he will retire from his business (as reportedly he might be contemplating). At <br /> <br />this point in the discussion of this matter, Mr. Kenneth M. Smith, owner of the Solo <br /> <br />Company, a restaurant equipment supplier located in Collinsvi1le, Virginia, speaking to <br /> <br />this matter, advocated a much longer period (than now permitted under the Fire Preven- <br /> <br />tion Code) for restaurant owners to meet the requirements or to decide otherwise,al1eging <br /> <br />that some restaurant owners can not afford the costs involved and, moreover, alleging <br /> <br />that follow-up inspection and enforcement (by the City) is lacking to the extent that <br /> <br /> <br />some restaurant owners, having been cited for non-compliance, by resorting to cost- <br /> <br />cutting measures, have installed sub-standard equipment for which, in effect, compliance <br /> <br />- <br />
