<br />~86 <br /> <br />TUESDAY FEBRUARY 28, 1984 <br /> <br />permits have been issued by the City. City Manager Edmonds, responding to the allega- <br /> <br />tion that the City has failed in its follow-up inspection and enforcement procedures, <br /> <br />asserted that, this being an administrative matter, Mr. Smith should have brought this <br /> <br />allegation to Mr. Edmonds' attention. Councilmember Severt then reported the substance <br /> <br />of conversations between her and Mr. Mayhew, indicating that Mr. Mayhew will file an <br /> <br />appeal with the Board of Appeals, as well as between her and City Manager Edmonds on <br /> <br />this matter and the role of said Board of Appeals. And, in response to Mayor Cole's <br /> <br />query of City Attorney Worthy as to Council's role in such matters, looking toward <br /> <br />other classes of businesses yet to be inspected for compliance or non-compliance and <br /> <br />the probability of similar problems developing, Mr. Worthy indicated that he should have <br /> <br />advance notice of matters coming before Council in which he is expected to render a <br /> <br />legal opinion. Mayor Cole then cited his reasons for bringing this matter to Council's <br /> <br />attention at this point, viz., to give members of Council an opportunity to discuss it <br /> <br />openly as well as to be aware of ".... .what it did in 1982", i.e., its last updating of <br /> <br />the Fire Prevention Code and the impact (of requirements) upon local business firms. <br /> <br />To update, as to indemnification, a resolution adopted by Council in the 1950's in con- <br /> <br />nection with permits obtained by the City from the Virginia Department of Highways & <br /> <br />Transportation within highway rights-of-way, Council unanimously adopted the following <br /> <br />resolution: <br /> <br />WHEREAS, it becomes necessary from time to time for the City of <br />Martinsville, Virginia, to obtain permits from the Virginia Depart- <br />ment of Highways and Transportation to install, construct, recon- <br />struct, maintain, and operate certain public works along, across, <br />over and upon the highway system of Virginia; and <br /> <br />WHEREAS, expense, damage or injury may be sustained by the Common- <br />wealth of Virginia growing out of the granting to said City of <br />Martinsville by the Virginia Department of Highways and Transpor- <br />tation of said permits for the work aforesaid; and <br />
