<br />TUESDAY, NOVEMBER 25, 1986 <br /> <br />Sec. 5-39. Noisy Dog. <br /> <br />No person shall have or keep within the city any dog or dogs <br />which, by making or causing frequent or long-continued and unrea- <br />sonable noise, shall disturb the peace and quiet of any person or <br />neighborhood. Upon complaint being made to any animal warden or <br />police officer that the provisions of this section are being vio- <br />lated, such animal warden or police officer, as the case may be, <br />may, after investigation, give notice of such complaint to the <br />owner or person in charge of such dog or dogs and order the discon- <br />tinuance of the disturbance. <br /> <br />Any person failing to comply with such order shall be guilty of <br />a Class 4 misdemeanor. <br /> <br />Pursuant to Council's November 11th request, City Manager Brown reported that, after <br /> <br />studying his prior-proposed amendment to Section 13-37 of the City Code (regarding <br /> <br />excessive growth of weeds, etc.), he now recommends Council's adoption of a slightly <br /> <br />revised version which retains the previously-recommended 18" limitation on weeds and <br /> <br />vegetative growth and now includes .......if an occupied building or residence is <br /> <br />situated on an adjacent side lot." Members of Council expressed concerns with the <br /> <br />ability to enforce this version as well as with probabilities that, in "hardship" <br /> <br />cases (particularly properties with steep slopes), some manner of waiving the re- <br /> <br />quirements should be delineated. Concurring with Council's expressed concerns was <br /> <br />Mr. James D. Coleman, Jr., President of Rives S. Brown, Inc., owner of many "steep- <br /> <br />slope" and/or almost inaccessible properties within the Forest Park and Druid Hills <br /> <br />Subdivisions. Council referred this proposed ordinance back to the City Manager for <br /> <br />further study, taking into consideration the "hardship" aspects mentioned. <br /> <br />Council acknowledged receipt of a financial statement (i.e., report) from the <br /> <br />Martinsville-Henry County Economic Development Corporation for its year ended June <br /> <br />30, 1986. <br /> <br />Council also acknowledged a report presented by Mrs. Nancy N. Henderson, Chairman of <br /> <br />the Martinsville-Henry County Clean Community Commission, noting that the Commission <br /> <br />has recently initiated a new sign program for better recognition of firms and <br />
