<br />20 <br /> <br />TUESDAY, NOVEMBER 11, 1986 <br /> <br />In accordance with duly-published notice, Council conducted a public hearing on a <br /> <br />recent petition filed by JAMCARR, Inc., recommended for Council's approval by the <br /> <br />City's Planning Commission, seeking modification of the Special-Use Permit issued in <br /> <br />1974 to Buena Vista, Inc., whereby petitioner will be allowed to vary from the <br /> <br />initially-approved design of seven structures of eight townhouses each on property <br /> <br />abutting Pine Hall Road to a "village" concept consisting of the same number of (56) <br /> <br />units in the form of eight structures of five units each and four structures of four <br /> <br />units each. In addition, the Planning Commission recommended that construction <br /> <br />begin within twelve months and be completed within five years. Mr. George B. Adams, <br /> <br />Jr., a member of the Planning Commission, in person and by letter urged that modifi- <br /> <br />cation approval include ......a requirement that the Planning Commission appropri- <br /> <br />ately address the issue of fencing and screening", a concern for which has been <br /> <br />expressed by nearby neighbors. Appearing on behalf of the petitioner (JAMCARR, <br /> <br />Inc.) was Mr. David W. Reeves, Architect, who informed Council that the units, when <br /> <br />constructed, will not be "for rent" nor will they be "subsidized" but will be <br /> <br />offered for sale in the $40,000.00-range. There being no other persons to speak to <br /> <br />this matter, Mayor Oakes declared the public hearing as closed. Vice-Mayor Williams <br /> <br />then introduced his motion (seconded by Councilman Cole) that the petiton be granted <br /> <br />upon the condition that the project not be subsidized. In so doing, Mr. Williams <br /> <br />emphasized his position that he is not against subsidized housing (per se) but does <br /> <br />oppose there being more than one (there being already one subsidized housing <br /> <br />project) in the same general area. Upon advice from City Attorney Worthy that the <br /> <br />condition stipulated by Mr. Williams might not be considered legally valid, Vice- <br /> <br />Mayor Williams withdrew the motion, as did Mr. Cole his "second". Councilman <br /> <br />McClain then introduced his motion that the petition be granted and the Planning <br /> <br />Commission's recommendations thereon be accepted, based on representations made (by <br /> <br />petitioner) to the Planning Commission. Mr. McClain's motion was duly seconded and <br /> <br />unanimously carried. <br />
