Opposing the application and the proposed issuance <br /> <br />of a special-use permit and speaking to this matter before Council were the <br /> <br />following area citizens, represented by Mr. Phillip G. Gardner, Attorney at <br /> <br />Law: <br /> <br />1. Mr. William K. Moles, 901 Dundee Court; <br />2. Mr. Kenneth E. Wilson, 900 Dundee Court; <br />3. Mrs. Ashby R. Pritchett, 715 Corn Tassel Trail; <br />4. Mr. W. S. ("Dink") Gardner, 711 Corn Tassel Trail; <br />5. Mr. Robert L. Brown, 725 Corn Tassel Trail; and <br />6. Mr. Harold B. Cumberledge, 717 Corn Tassel Trail. <br /> <br />This hearing began with a review by City Manager Brown of proceedings on this <br /> <br />matter to this point, including the Planning Commission's recommendation that <br /> <br />the special-use permit be issued with two specific "conditions" made a part <br /> <br />thereof, viz., (1) that construction of the project begin within six months <br /> <br />from date of approval and project be completed within two years from starting <br /> <br />date, and (2) a storm management plan be put together and implemented and, if <br /> <br />during project construction, the increase in stormwater runoff becomes such as <br /> <br />to cause damage to adjacent properties, the project will be halted until <br /> <br />corrective measures are taken. Mr. Leon E. Towarnicki, the City's Public Works <br /> <br />Director, reported that, because of concerns previously expressed by several <br /> <br />citizens residing on Dundee Court relating to stormwater runoff, his examina- <br /> <br />tion of present drainage facilities in the 27-acre drainage area between <br /> <br />portions of Spruce Street and Corn Tassel Trail, coupled with the projected re- <br /> <br />alignment and reconstruction of the section of Spruce Street nearby, indicates <br /> <br />that--despite some anticipated increase in rainwater runoff--said facilities <br /> <br />are more than adequate. Mr. Reeves then presented diagrams and site plans for <br /> <br />the proposed townhouse project and, also, described rainwater dispersal <br /> <br />facilities to be installed. Concerns and objections expressed and registered <br /> <br />by the aforenamed area citizens evolved around the questions of (1) whether <br /> <br />properties on Dundee Court might be damaged from stormwater runoff and (2) <br /> <br />
