Gardner, Attor- ney at Law, appeared before Council and informed Council that he represents a number of citizens residing in the area abutting the tract of land on which the townhouses are proposed to be built and that, at said forthcoming September 25th public hearing, he will vigorously oppose the issuing of the required per- mit as well as the project itself through a presentation of evidence on behalf --- of his clients. In addition, Mr. Gardner claimed that the Planning Commis- sion's recommendation on said application was (and is) conditional and, there- fore, it should be returned to the Planning Commission for a non-conditional recommendation; otherwise, Council is forced to make a factual decision that should be made by the Planning Commission. In response to a query from Councilman McClain, City Attorney Worthy advised that Council may--as it has before--grant special-use permits with conditions attached. Mr. William K. Moles. of 901 Dundee Court, whose property abuts the proposed townhouse project, urged members of Council to visit the site and, also, urged that a comprehensive water containment or runoff study be made before final action is taken by Council on the application. -- Upon motion, duly seconded and unanimously carried, Council adopted the following ordinance (identified as Ordinance No. 86-6), as introduced at Council's recent August 26th meeting, which amends Sections 5-37 and 5-55 of the City Code: Ordinance No. 86-6 BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in regular session held September 9, 1986, that Chapter 5. Article III, Dogs, of the City Code be and is hereby amended, as follows:
