Gardner, Attor- <br /> <br />ney at Law, appeared before Council and informed Council that he represents a <br /> <br />number of citizens residing in the area abutting the tract of land on which the <br /> <br />townhouses are proposed to be built and that, at said forthcoming September <br /> <br />25th public hearing, he will vigorously oppose the issuing of the required per- <br /> <br />mit as well as the project itself through a presentation of evidence on behalf <br /> <br />--- <br /> <br />of his clients. In addition, Mr. Gardner claimed that the Planning Commis- <br /> <br />sion's recommendation on said application was (and is) conditional and, there- <br /> <br />fore, it should be returned to the Planning Commission for a non-conditional <br /> <br />recommendation; otherwise, Council is forced to make a factual decision that <br /> <br />should be made by the Planning Commission. In response to a query from <br /> <br />Councilman McClain, City Attorney Worthy advised that Council may--as it has <br /> <br />before--grant special-use permits with conditions attached. Mr. William K. <br /> <br />Moles. of 901 Dundee Court, whose property abuts the proposed townhouse <br /> <br />project, urged members of Council to visit the site and, also, urged that a <br /> <br />comprehensive water containment or runoff study be made before final action is <br /> <br />taken by Council on the application. <br /> <br />-- <br /> <br />Upon motion, duly seconded and unanimously carried, Council adopted the <br /> <br />following ordinance (identified as Ordinance No. 86-6), as introduced at <br /> <br />Council's recent August 26th meeting, which amends Sections 5-37 and 5-55 of <br /> <br />the City Code: <br /> <br />Ordinance No. 86-6 <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular session held September 9, 1986, that Chapter 5.
